Strateški pristup sistemu javnih nabavki

Abstract

Правилно постављен систем јавних набавки обезбеђује реали- зацију више значајних циљева који доприносе расту јавних и приват- них инвестиција и унапређењу квалитета живота људи. Слободна конкуренција омогућава држави да под најповољнијим условима набавља добра, услуге и радове потребног квалитета, а привред- ним субјектима да под равноправним условима добију прилику да послују са државом. Количина предмета јавних набавки пружају јавној управи могућност да обликује тржиште и да има значајан утицај на остваривање економских, социјалних и еколошких циљева. Најважнији ефекти делотворних јавних набавки су квалитетније функционисање јавног сектора, а тиме и квалитетније јавне услуге грађанима и привредним субјектима. Наведени значај захтева стратешки приступ, заснован на темељној анализи постојећег стања јавних набавки. То подразуме- ва испитивање регулаторног и институционалног оквира, разлога за неспровођење норми или негативних ефеката, разлога слабијег функционисања институција, потенцијала људских ресурса свих учесника, степена делотворности и економичности јавних набав- ки у пракси, врсте, обима и узрока нерегуларности, начина њиховог откривања и санкционисања, као и правне заштите учесника у по- ступцима јавних набавки. На основу спроведених анализа потреб- но је одредити кључне приоритете, циљеве и мере којима ће се ти циљеви постићи. То подразумева и активно учешће свих релевант- них учесника у систему, а посебно кључних заинтересованих страна и шире стручне јавности, како би се у потпуности сагледали сви проблеми и проценили њихови узроци и поставиле препоруке и механизми за њихово отклањање. Истовремено, тиме се код свих учесни- ка повећава разумевање стратешких поставки и предвиђених мера у области јавних набавки и повећава вероватноћа за њихову успешну примену. Чланак се бави питањима окружења јавних набавки правног и институционалног оквира, економског окружења, административ- них и инститиционалних капацитета који се базирају на развоју људских ресурса и дигитализацији процеса у контексту повећања апсорпционе моћи за имплементацију регулативе у процесу придру- живања ЕУ, као и анализом Предлога нове Стратегије развоја јав- них набавки, у настојању да се допринесе коначном уобличавању стратешког приступа у овој области.

Properly set up the public procurement system provides the realization of several significant goals that contribute to the growth of public and private investment and improving the quality of life of people. Free competition allow state that under the best conditions procure goods, services and works required quality, and businesses that under equal conditions have the opportunity to do business with the state. The amount of the object of public procurement provides the public administration the ability to shape the market and have a significant impact on the realization of economic, social and environmental objectives. The most important effects of effective public procurement is better functioning of the public sector, and thus the quality provision of public services to citizens and businesses. The aforementioned importance requires a strategic approach, based on a thorough analysis of the current state of public procurement. This includes examination of the regulatory and institutional framework, the reasons for not implementing regulation or its adverse effects, reasons for poor functioning of institutions, potential human resources of all stakeholders, the degree of effectiveness and cost-effectiveness of public procurement procedures in practice, the type, extent and causes of irregularities, ways of detecting and sanctioning, and legal protection of participants in public procurement procedures. Based on the above analysis is necessary to determine key priorities, objectives and measures to achieve these objectives. This includes the active participation of all relevant stakeholders in the system, especially the key stakeholders and the wider professional community, in order to fully comprehend the problems and assess their causes and has placed recommendations and mechanisms for their elimination. At the same time, this increases the understanding of strategic settings and envisaged public procurement measures for all participants and increases the likelihood of their successful implementation. This article deals with issues of public procurement environment, legal and institutional framework, economic environment, administrative and institutional capacities based on human resources development and process digitization in the context of increasing the absorption power for the implementation of regulations in the EU accession process, as well as the analysis of the Proposal of the new Public Development Strategy procurement, in an effort to contribute to the final formulation of a strategic approach in this area.
