Šta je "autoplagijat"?

AB  - U današnjoj klimi pojačane društvene pažnje u vezi sa plagijarizmom, u globalnoj akademskoj zajednici se kao poseban oblik etički problematičnog ponašanja sve češće označava i praksa autoplagiranja. Ako se za plagijat i može reći da je bio predmet podrobnih pojmovnih analiza, to nije slučaj sa autoplagijatom. Ovaj kratak osvrt ima za cilj pokušaj te vrste. Polazeći od odredbe čl. 25 Kodeksa profesionalne etike Univerziteta u Beogradu, razmatraju se najbitnija obeležja ovog akademskog etičkog prestupa. U preduzetoj pojmovnoj analizi se utvrđuje da se tvorac Kodeksa opredelio da inkriminiše kao etički neprihvatljivu samo užu praksu "duplog objavljivanja" (duplicate or dual publication). Zaključuje se da i u slučaju pribegavanja takvoj praksi ne može biti govora o etičkom prekršaju autoplagiranja ako autor jasno naznači da ponovo objavljuje/upotrebljava vlastiti ranije objavljeni ili na drugi način iskorišćeni rad, odnosno delove rada.
AB  - In today's era of heightened sensitivity to plagiarism, self-plagiarism is gaining recognition as a distinct ethical concern within the global academic community. While plagiarism has undergone detailed conceptual analysis, the same cannot be said for self-plagiarism. This concise review seeks to address this gap by examining key aspects of this academic ethical issue, as outlined in Article 25 of the Code of Professional Ethics at the University of Belgrade. Through this conceptual analysis, it becomes apparent that the Code specifically condemns the narrower practice of "duplicate or dual publication" as ethically unacceptable. It is clear that self-plagiarism does not occur when an author transparently acknowledges their intention to republish or reuse their previously published or utilized work, including its constituent parts.

How to justify "militant democracy': Meta-ethics and the game-like character of democracy

AB  - Decisions in democracy are binding not in virtue of being true or good, but on account of being an outcome of the majority voting procedure. For some, this is a proof of an intricate connection between democracy and moral relativism. The militant democracy' model, on the other hand, is premised on the idea that certain political actors and choices have to be banned for being fatally bad for democracy. This gives rise to the claim that protected democratic fundamental values of freedom and equality enjoy the status of absolute moral standards. This article dismisses the intuition that justification of militant democracy' depends on unpacking the relation between democracy and meta-ethics. Instead, following Bernard Suits' analytical exposition of the important features of games, it demonstrates, first, how democracy is like a game and, then, it argues that a plausible justification of militant democracy' stems from its game-like character.

Responsibility to Protect and the International Rule of Law

AB  - After being initially drafted in 2001 by an expert body-the International Commission on Intervention and State Sovereignty-the "responsibility to protect" (R2P) doctrine has eventually found its way into the 2005 UN World Summit Outcome document, thereby replacing a morally controversial doctrine of "humanitarian intervention". The paper aims, first, to point out how these two doctrines are different ethical projects. Second, recognizing that it is safer to say that the doctrine has not become a principle of law, this paper tries to situate it within the prevalent value of the international rule of law. It does so by exploring two somewhat contrasting conceptions-one more substantive in nature, which takes individuals as ultimate beneficiaries of this value, and the other, more formal in nature, which puts states in the forefront. The R2P case shows, however, that neither of them can be advanced to the full extent.

After the ICJ's Advisory Opinion on Kosovo: The future of self-determination conflicts

AB  - Despite the expectation that the ICJ’s Advisory Opinion on Kosovo will profoundly contribute to the clarification of international law on self-determination, the Court, nevertheless, confined itself to a rather narrow reading of the submitted question. Yet, I will argue that some of its findings are of general nature. Such are the following conclusions: 1. that 'general international law contains no applicable prohibition of declarations of independence', except in cases where they are in connection with a violation of general international legal norms of jus cogens; 2. that 'the scope of the principle of territorial integrity is confined to the sphere of relations between States' and, hence, does not concern non-state actors, including secessionist groups; and 3. that 'persons who acted together in their capacity as representatives of the people' of some territory under the UN interim regime of governance are not bound to act within the framework of powers and responsibilities established to govern the conduct of provisional institutions. I will argue, furthermore, that these findings might have disastrous consequences for the future of self-determination conflicts. First, by being excluded from the duty to respect the jus cogens norm of territorial integrity, secessionist groups, as non-state actors, might be inclined to use all possible means, including the violent ones, to seize as much power as possible over delineated piece of territory of the recognized state. Second, secessionists may now even more relentlessly resort to the issuing of UDIs, while simultaneously searching for some patron(s) among Great Powers, which would at the critical moment back up their strive for statehood, by formally recognizing the new entity as a state. This, in turn, may even affect the role of ‘recognition theory’ in international law. Finally, states drawn into prolonged self-determination conflicts with their rebellion minorities will be dissuaded from entering into provisional UN-mandated conflict-settlement arrangements, because no guarantee will exist that ‘representatives of a self-determining people’ would not unilaterally dissolve them.

AB  - The first part of the paper focuses on the current debate over the universality of human rights. After conceptually distinguishing between different types of universality, it employs Sen's definition that the claim of a universal value is the one that people anywhere may have reason to see as valuable. When applied to human rights, this standard implies "thin" (relative, contingent) universality, which might be operationally worked-out as in Donnelly's three-tiered scheme of concepts conceptions- implementations. The second part is devoted to collective rights, which have recently become a new topic of the human rights debate. This part provides the basis of political-philosophical justification and legal-theoretical conceptualization of collective rights, as rights directly vested in collective entities. The third part dwells on the problem of universality of collective rights. It differentiates between the three main collective entities in international law-peoples, minorities, and indigenous peoples-and investigates whether certain rights vested in these collectives might, according to Sen's standard, acquire the status of the universal ones. After determining that some rights are, in principle, plausible candidates for such a status in international law, this paper concludes by taking notice of a number of the open issues that still need to be settled, primarily by the cooperative endeavor of international legal scholars and legal theorists.

AB  - Ovaj rad nastoji da pokaže da pravnoteorijsku obradu pitanja koje se tiče promovisanja izvesnih kolektivnih entiteta u status titulara prava nije moguće na zadovoljavajući način izvršiti unutar metodoloških obrazaca bilo Hartove analitičke jurisprudencije, bilo Kelzenove Čiste teorije prava. Pokazuje se da je pitanje konceptualizacije kolektivnih prava u dobroj meri pitanje opravdavanja, a ne pukog analiziranja ili opisivanja. U tom smislu ovaj rad je fokusiran na rasvetljavanje različitih aspekata problema pravnog oblikovanja društvenog identiteta relevantnih kolektiviteta u svrhu konstrukcije pravnog subjektiviteta. U prvom delu se u kratkim crtama pokazuje da je pitanje pravnog subjektiviteta generalni problem sa kojim se suočava pravna teorija i da, otuda, nema ničeg specifično novog u vezi sa kolektivitetima kao potencijalnim titularima prava. Drugi deo rada posvećen je podrobnijem razmatranju društvene i pravne 'konstrukcije različitosti', na kojem je zasnovan koncept kolektivnih prava. Krajnji zaključak je da pravna teorija kolektivnih prava ove zadatke teško može obaviti bez oslona na metodološki aparat kako sociološke, tako i antropoloških disciplina.
AB  - The paper argues that the legal-theoretical treatment of the issue of promoting certain collective entities to the status of legal entities cannot be satisfactorily accomplished within the methodological models of either Hart's analytical jurisprudence or Kelsen's Pure Theory of Law. The question of the conceptualization of collective rights proves to be largely a question of justification rather than one of mere analysis or description. In this sense, the paper proposes to elucidate various aspects of the problem of the legal shaping of the social identity of relevant collective entities with the purpose of constructing legal personality. The first section of this paper briefly shows that the question of legal personality is a general problem of legal theory, and that there is consequently nothing specifically new about collective entities as potential legal entities. The second section of the paper considers in greater detail the social and legal 'construction of diversity', on which the concept of collective rights is based. Finally the paper suggests that the legal theory of collective rights can hardly accomplish these tasks without recourse to the methodological apparatus of both sociological and anthropological disciplines.

AB  - Autori nastoje da skiciraju dosadašnji razvoj međunarodnog prava ljudskih prava. U tom smislu ističu da razvitak ove oblasti prava predstavlja iskorak u odnosu na klasično međunarodno pravo, utoliko što je došlo do priznanja međunarodno-pravnog subjektiviteta pojedinaca, kao i do rađanja svojevrsnog globalnog civilnog društva. Dokument kojim je utrt taj put bila je Univerzalna deklaracija o ljudskim pravima iz 1948. godine. Danas, šest decenija od njenog donošenja, moguće je, ipak, uočiti izvesne znakove krize celokupnog projekta razvitka ljudskih prava. Njegove pristalice neretko zagovaraju neku vrstu ekskluzivizma u pogledu prirode ove oblasti prava čime doprinose fragmentaciji međunarodnog javnog prava. Istovremeno međunarodne nevladine organizacije u ovom domenu predmet su kritika zbog svog pristrasnog političkog angažmana i odsustva odgovornosti. Najzad projektu ljudskih prava se prebacuje da nameće kulturne obrasce zapadnih društava. Autori, otuda, zaključuju da je pravo vreme za sve iskrene privrženike ideji ljudskih prava da se odreknu trijumfalističke retorike i samozadovoljstva i da se posvete trezvenom i kritičkom samopromišljanju o tome šta je učinjeno, šta se čini, a naročito o tome šta tek treba da se uradi u oblasti zaštite ljudskih prava.
AB  - The authors tend to sketch the up to now development of international human rights law. In that respect, they emphasize that the development of this field of law represents a significant improvement of the classical international law, insofar as it recognized the legal subjectivity of individuals, and fostered the creation of a global civil society. The document that paved the way for this development was the 1948 Universal Declaration on Human Rights. Six decades later, it is possible, however, to trace certain signs of crisis of the human rights project. Its promoters often propagate some sort of exclusivism of this field of law, thus contributing to the fragmentation of public international law. At the same time, international human rights NGOs are subject to criticism for their politically biased engagement and the lack of responsibility. Finally, the human rights project is often criticized for imposing cultural patterns of Western societies. The authors, thus, conclude that it is the right time for sincere human rights devotees to abandon triumphant rhetoric and self-complacency and to engage in a sober and critical self-reflection of what has been done, what is being done and, in particular, what is yet to be done in the area of human rights protection.

In this sense, the paper proposes to elucidate various aspects of the problem of the legal shaping of the social identity of relevant collective entities with the purpose of constructing legal personality. The first section of this paper briefly shows that the question of legal personality is a general problem of legal theory, and that there is consequently nothing specifically new about collective entities as potential legal entities. The second section of the paper considers in greater detail the social and legal "construction of diversity", on which the concept of collective rights is based. Finally, the paper suggests that the legal theory of collective rights can hardly accomplish these tasks without recourse to the methodological apparatus of both sociological and anthropological disciplines.",

AB  - Polazeći od formulacija nekoliko odredbi, kako unutrašnjeg, tako i međunarodnog prava, autor pokušava da utvrdi da li se, pored fizičkih i pravnih lica, može govoriti o nastanku treće kategorije subjekata prava - kolektiviteta, odnosno grupa. Iako pogotovo neke norme međunarodnog javnog prava nedvosmisleno upućuju na takav zaključak, autor se opredeljuje za ispi tivanje zasnovanosti takvoga koncepta unutar nekoliko pravnoteorijskih modela. U tom pogledu, autor nastoji da pokaže da koherentan koncept ko lektivnih prava nije moguće zasnovati u interesnoj teoriji Dž. Raza, kao ni u teoriji participatornih dobara D. Reoma, već jedino u onoj koja u osnovi sle di postavke korporativne teorije P. Džounsa. Ova teorija je, opet, neraski divo povezana sa stanovištem "vrednosnog kolektivizma", prema kojem su kolektiviteti inherentno vredni.
AB  - Proceeding from wording of several legal provisions, both of domestic and international law, the author tries to determine whether, besides natural and juristic persons, one may speak about the emergence of the third category of right-holders - collectives, groups. Though particularly certain norms of public international law indisputably imply this kind of conclusion, the author nevertheless decides to examine the justifiability of this concept within several legal-theoretical models. In this respect, the author tends to demonstrate that the coherent concept of collective rights is not possible to ground neither in the interest theory of J. Raz, nor in the theory of participatory goods of D. Reaume, but only in the one that follows the basic propositions of the corporate theory of P. Jones. This theory is, on the other hand, tightly connected to the standpoint of "value-collectivism" according to which collectives are intrinsically valuable.

AB  - U nastojanju da ponudi prolegomenu za jednu sveobuhvatnu pravnu teoriju kolektivnih prava, autor razmatra nekoliko najvažnijih problema. Prvi od njih se odnosi na kriterijume za definisanja kolektivnih prava. Autor za­stupa tezu da ono što prevashodno određuje prirodu kolektivnog prava nije način vršenja prava, već pre karakter samog titulara, odnosno kolektiviteta, koji se razlikuje i od fizičkih i od pravnih lica. Zatim, autor upozorava da ne treba mešati kolektivitete sa užim klasama subjekata čiji je pravni status u pravnom poretku regulisan delimično opštim normama. Kada je reč o zastupanju kolektiviteta, autor smatra da rešenje treba tražiti u stvaranju posebnog predstavničkog tela kolektiviteta, aktom javnog prava, čiji bi personalni sastav birali sâmi njegovi članovi, kako bi interesi tog kolektiviteta na što autentičniji i reprezentativniji način bili predstavljeni. Najzad, autor dopušta mogućnost da se kolektivnim pravima ponekad ograničavaju i individualna prava pripadnika kolektiviteta. No, smatra, prvo, da u liberalno-demokratskom društvu moraju postojati određena osnovna indiviudalna prava koja su nenapadiva i, drugo, da je ograničavanje onih prava koja to nisu legitimno samo onda kada kolektivitet može da dokaže postojanje pretežnog interesa i da se postizanje tog interesa ne može postići nekim manje restriktivnim sredstvima.
AB  - In an attempt to offer prolegomena for a comprehensive legal theory of collective rights, the author discusses several most important issues. First of them concerns the criteria for defining collective rights. The author advances the thesis that what primarily determines the nature of a collective right is not the way that right is exercised, but rather the character of the right-holder, i.e. collective, which is different both from natural and juristic persons. Furthermore, the author emphasizes that one should not confuse between collectives and narrow classes of subjects, whose legal status is determined by partly general legal norms. When it comes to the problem of representation, the author argues that a solution might be found in the creation, by an act of public law, of the special representative body of collective, which would be elected by members themselves, which, in turn, would lead to a more authentic representation of collective interests. Finally, the author allows the possibility that collective rights might sometimes override rights of the individual members of the collective, but he considers, first, that in a liberal-democratic society certain fundamental individual rights should never be infringed, and, second, that the restriction of other individual rights and liberties can be legitimate only if collective can prove it has a relevant compelling interest, and that the realization of this interest could not be achieved through less restrictive measures.

AB  - Uprkos još uvek nerešenim teorijskim pitanjima, kao što su pravna i politička priroda "Evropskog Komonvelta", problem njegovog "demokratskog deficita" i mogući načini da se on prevaziđe, međusoban odnos evropskog građanstva i evropskog identiteta, kao i neslaganje oko stvarne potrebe za konstitucionalizacijom Evropske unije i izvodljivosti iste, Evropska unija je ipak na dobrom putu da na kraju bude uređena ustavnim aktom. AB  - This article argues that the widely justified and internationally promoted model of minority protection can only operate effectively by transcending the still dominant framework of individual rights and incorporating the concept of collective rights. In defending that position, this article will elucidate the main legal theoretical dilemmas of the concept of collective rights. Sustaining a coherent concept of collective rights requires recognition of the intrinsic, non-instrumental value of certain collective entities and of the fact that not all groupings are entitled to be moral and legal rights bearers. Legal criteria for defining collective rights can also be established, by distinguishing this notion from affirmative action measures, jointly exercised individual rights, and somewhat universal general legal norms. Furthermore, the lack of homogeneity within minority culture, religion, language, etc., could be legally overcome if bodies representing the interests of minorities are founded on the principles of voluntariness, electoral accountability, proportionality, and democracy. Ultimately, although this approach creates the possibility of conflicts between collective and individual rights, it can provide legal techniques for balancing the interests of individuals, respective collectives, and the state.

Autor smatra da se radi zadovoljenja specifičnih kulturno definisanih interesa mora prihvatiti pojam kolektivnih prava, i nastoji da skicira opštu pravnu teoriju kolektivnih prava. Tekst se završava ukazivanjem na više teškoća sa kojima bi takva teorija morala da se suoči ukoliko bi bila dalje razvijana.
AB  - This paper should be understood as a brief sketch, or at best as a prolegomena to one comprehensive legal theory of collective rights. I would subscribe to Varady's opinion that "the acceptance of the notion of collective rights would not solve all problems automatically. However, if we are to comply with reality, and to acknowledge what was up until now largely "unacknowledged presence, we need to develop such theory. This certainly would not be an easy task, concerning the fact that besides its genuine objectives, the precise classification of all collective rights being just one of them, this theory will also have to deal with issues from sociology or cultural anthropology. For instance, it will have to address the problem of group membership, which "can be fluid and uncertain". Accordingly, it will have to answer "how to define the boundaries of the collectivity in a non-arbitrary and non-coercive way. Furthermore, legal theory of collective rights should face the problem of manipulation or coercive imposition of collective identities. Similarly collective rights may fix collective identities too rigidly and, thus oppressively. And finally, "communities and cultures are not static, so that the interplay of identity, difference and rights should not be arbitrarily terminated for the sake of some hegemonic interpretation of community. The fact that legal theory of collective rights should have particular philosophical basis, and that it should lean on the methodological tools of other disciplines, as well, implies that such theory can not be the Reine Rechtslehre, but, quite contrary, one integral theory about the concept of collective rights.
