abstract = "U Izveštaju Evropske komisije o napretku Srbije za 2014. godinu između
ostalog se navodi da „tek treba usvojiti nov zakon o upravnom postupku”. Sredinom
2013. godine, ranije Ministarstvo pravde i državne uprave Srbije objavilo je
Radnu verziju Nacrta Zakona o opštem upravnom postupku. U međuvremenu
formirano je posebno Ministarstvo za državnu upravu i lokalnu samoupravu,
koje je Nacrtom Akcionog plana za sprovođenje reforme javne uprave Srbije za
period od 2014. do 2016. godine predviđeno da izradi Nacrt Zakona o opštem
upravnom postupku. Međutim, taj Nacrt je još uvek u nadležnosti Ministarstva
pravde. Uočava se slab kvalitet Obrazloženja Nacrta, protivrečne formulacije
o predmetu regulacije, o upravnoj stvari i dr. U odnosu na postojeći Zakon o
opštem upravnom postupku (ZUP), Nacrt ZUP-a sadži određene izmene i dopune
u pogledu pravnih sredstava. S jedne strane, određena pravna sredstva
zadržava (žalba, ponаvljаnje postupkа, menjаnje i poništаvаnje rešenjа u vezi
sа uprаvnim sporom, poništаvаnje i ukidаnje po osnovu službenog nаdzorа i
oglаšаvаnje rešenjа ništаvim), s druge, uvodi novo (prigovor) i, konačno, neka
postojeća izostavlja (ukidanje i menjanje pravnosnažnog rešenja uz pristanak
ili po zahtevu stranke, vanredno ukidanje). U radu je dat detaljni osvrt na žalbu
i prigovor, uz komparativni osvrt na Zakon o općem upravnom postupku
Hrvatske i Nacrt Zakona o opštem upravnom postupku Crne Gore., The 2014 Serbia Progress Report of the European Commission states that
the „Law on General Administrative Procedure is still to be adopted”. In mid
2013, the previous Ministry of Justice and Public Administration announced
a Working Version of the Draft of the Law on General Administrative Procedure.
In the meantime, a new Ministry of Public Administration and Local Self-
Government was formed, which has charged by the Action Plan for the Implementation
of the Strategy for the Reform of the Public Administration of Serbia
for the 2014–2016 period as the responsible agency for the drafting of the new Law on General Administrative Procedure. However, the Draft is still within
the competence of the Ministry of Justice. The quality of the Narrative of the
Draft is very poor, and there are many contradictory formulations regarding the
subject matter, the nature of administrative matters, etc. In regard to the existing
Law, the Draft Law contains certain differences related to legal remedies.
On one hand, some legal remedies are kept (appeal, review, administrative dispute,
administrative supervision, annulment, on the other hand, a new remedy
is introduced (objection), and finally some are excluded (extraordinary cancellation).
The article deals in detail with the appeal and objection, and offers
comparative insight in regard to these remedies in the Law on General Administrative
Procedure of Croatian and the Draft Law on General Administrative
Procedure of Montenegro.",
