The importance of the right to a healthy environment during the pandemic

AB  - The protection and preservation of the environment and stable climatic conditions, as well as the right of public participation in environmental decision-making in public spaces, are emerging as topics of special significance, especially during the COVID-19 pandemic. The need for integrated protection of natural goods of general interest, harmonization with the EU acquis, the need to simultaneously overcome the COVID-19 crisis and implement the Green Agenda for the Western Balkans raises numerous questions, some of them being: is environmental protection a priority during the pandemic and, if so, which aspects of environmental protection represent the primary concern; have the measures limiting public gatherings had an impact on public participation in decision-making; and, do the proposed legislative amendments and additions complete the environmental protection system, with clear criteria for an environmental impact assessment of the related activities and the decisions to support their pursuit?

AB  - U radu se analizira status međunarodnih sporazuma iz oblasti zaštite vazduha kako bi se utvdio stepen usaglašenosti pozitivnog prava sa standardima potvrđenih međunarodnih sporazuma. Imajući u vidu postupak harminizacije prava Srbije sa pravom EU, u radu se ukazuje na obaveze država članica koje proizilaze iz Direktive 2008/50/EZ o kvalitetu vazduha i čistijeg vazduha za Evropu. U rade se iznose rezulati analize bogate praksa Suda pravde Evropske unije u kojoj se ukazuje na elemente koji određuju pravo pojedinca da pokrene postupak zaštite prava na zdravu životnu sredinu ukoliko država članica ne donese plan zaštite kvaliteta vazduha, kao i mere koje domaći sudovi mogu naložiti kako bi osigurali primenu odluke kojom se utvrđuje obaveza primene mera u cilju smanjenja emisija koje prevazilaze granične vrednosti. Imajući u vidu značajan broj predmeta u vezi sa zaštitom vazduha koje nalazimo u praksi Zaštitnika građana, analiza primene preporuka koje su proizašle iz tih predmeta ukazuje na stepen usaglašenosti preuzetih obaveza i njihove primene, kaoi pravce noveliranja pozitivnog prava.
AB  - The paper analyses the status of international agreements in the field of air protection, aiming to interpret the discord between the adopted legal standards and their application. Having in mind the harmonisation process of Serbian law with the EU law, the author further analyzes the obligations of Member States arising from Directive 2008/50/EC on Ambient Air Quality and Cleaner Air for Europe, the developed practice of the CJEU which embodies elements determining the rights of individuals to initiate a procedure for protecting the right to a healthy environment if states do not adopt an air quality action plan, as well as the measures that domestic courts may prescribe to ensure the implementation of decisions establishing the obligation to implement measures for reduction of emissions above the limit values. The concluding sections analyse the degree of harmonisation of our positive law with the adopted standards and the environmental acquis. Having in mind a substantial number of cases related to air protection in the practice of the Serbian Protector of Citizens (Ombudsman), the analysis of the application of recommendations arising from these cases may suggest the degree of harmonisation of commitments and their application, and serve as an instrument for amending positive law.

Standing in environmental law after Urgenda, Juliana and Covid-19 crises: who should force governments to act in environmental issues related to climate change?

AB  - Teaching environmental law and climate change issues one may open a number of questions on relations between environmental protection, governmental duties and public rights, starting with: has a government duty to care and maintain a dissent environment and stable climate conditions?; what is a ground for governmental decision-making on actions threatening sustainability of the climate conditions?; where is the beginning and the end of the responsibility of an individual or of an country? The article outlines the elements that provide the criteria under which one may discus on whether it should be the court to force the government to act or should it be a parliament to set laws initiating actions to protect citizens and their human rights from irreversible climate change? The article points out the recent cases State of the Netherlands v. Urgenda Foundation (court decision from December 2019) and Kelsey Cascadia Rose Juliana v. USA (court decision from January 2020). In Urgenda, the court concerned questions: whether the Netherlands is obliged to reduce the emission of greenhouse gases from its soil by at least 25% by the end of 2020 compared to 1990, whether the court can order the State to do so and whether the government is bound to protect human rights in climate crisis? In Juliana, a group of children between the ages of eight and nineteen filed suit against the federal government, claiming that the government violated their constitutional rights by causing dangerous carbon dioxide concentrations. Although the court had found the injury and evidence on causation between government's actions and climate crisis, it found a lack of redressability. The aim of the article is to examine if the concepts of European Green Deal presented on January 2019 by the Von der Leyen Commission to enshrine the 2050 climate neutrality target into life are in line with conclusions from analysed cases and lessons learned from COVID-19 crisis.

AB  - Ugroženost prava ili interesa pojedinca prouzrokovana lošim stanjem ili povećanim zagađenjem životne sredine nikada ne ostaje povreda naneta samo tražiocu zaštite. Novi pravni instituti koji bi omogućili efikasniju, ekonomičniju, blagovremenu i suštinsku zaštitu prava na životnu sredinu određenog kvaliteta treba da urede pitanja od značaja za zaštitu kada je povređen ili ugrožen interes pojedinca ili grupe, ali i dalje od toga, kada je reč o povredi prava na zdravu životnu sredinu kao posebnog javnog interesa. Vezivanje zaštite tog prava za javni interes, otvara pitanje značaja koji zaštita životne sredine ima u jednom društvu i načina na koji se vrši gradiranje javnih interesa među kojima je i interes zaštite životne sredine. U radu se, polazeći od navedene pretpostavke, ukazuje na načela ekološkog prava i dominantne karakteristike javnopravnog karaktera koje imaju uticaj na zaštitu prava na životnu sredinu određenog kvaliteta i u primeni privatnopravnih instituta pravne zaštite
AB  - The basis for procedural protection of environmental rights is found in administrative procedure. In order to establish guarantees of an adequate and effective legal protection in environmental matters by administrative law instruments, the general administrative procedure should be transformed. Traditionally a one-party procedure, the administrative procedure necessarily becomes a two-party procedure, involving the participation of the public concerned. The legal framework for the protection of property rights which endanger or jeopardize the state of the environment is contained in the substantive law. The Serbian legal system provides such protection by envisaging general institutes in the field of compensation for damage and regulation of property rights. The case law provides many examples that point to numerous inconsistencies in the system of environment protection in civil and administrative proceedings. Thus, for example, operators of general-purpose activities are obliged to compensate injured persons only for damage exceeding normal limits. On several occasions, the case law has shown that the compensation of non-material damage for sustained physical pain, due to the negative impact of industrial and adjacent objects on the environment, can only be granted if the existence of property damage exceeding the "normal limits" is established. In doing so, emissions must be of such intensity as to cause continuous physical pain. According to the case law, periodic emissions, even when they exceed the limit values during certain intervals, do not justify the compensation of non-material damage. The reasons for the underdeveloped legal institutes that provide environment protection are found not only in the fact that the issues of protection of a healthy or adequate environment of certain quality fall into a branch of law that has been developing since the 1970s but also in the fact that there is insufficient understanding of the principles on which environmental law is based and whose implementation entails the necessary and essential change of legal instruments in both public and private law. The plaintiffs in public or private proceedings concerning environmental issues do not only protect their own rights and interests but also the general interest of environment protection. Infringement of the rights or interests of an individual caused by increased environment pollution would never remain a hindrance only to the protection seeker. New legal institutes that would ensure a more efficient, economical, timely and substantive protection of environmental rights should regulate issues of relevance to protection when an individual or group's interest is endangered or jeopardized, as well as in the event of a violation of the right to healthy environment as a object of special public interest and value. Linking the protection of this right to the public interest raises the issues of importance that environment protection has in a society and the way in which public interests are graded, including the interest of environment protection. Starting from this assumption, the paper points to the principles of environmental law and the dominant features of public law which have a significant impact on environmental protection in cases where legal institutes of private law are applied.

Environmental protection through the prism of enlargement: time for reflection

AB  - In the wake of crises and "enlargement fatigue", EU politics deprioritized enlargement. Recently, however, the Commission motioned a reinvigorated enlargement prospect for the Western Balkans, identifying Serbia and Montenegro as the front runners. This paper advises that in going forward, the EU should also look back at its five decades of enlargement. The article focuses on environmental protection - a key EU public policy - and the way in which it features in the ever-evolving accession conditions and accession acts. It emerges that environmental protection has been marginalized throughout EU's enlargement history. Taking Serbia as a case study, it is shown that this is highly problematic, since environmental protection is linked to safeguarding the rule of law an essential criterion for EU membership. The role of environmental protection in the EU's enlargement policies should thus be reprioritized.

Recently, however, the Commission motioned a reinvigorated enlargement prospect for the Western Balkans, identifying Serbia and Montenegro as the front runners. This paper advises that in going forward, the EU should also look back at its five decades of enlargement. The article focuses on environmental protection - a key EU public policy - and the way in which it features in the ever-evolving accession conditions and accession acts. It emerges that environmental protection has been marginalized throughout EU's enlargement history. Taking Serbia as a case study, it is shown that this is highly problematic, since environmental protection is linked to safeguarding the rule of law an essential criterion for EU membership. The role of environmental protection in the EU's enlargement policies should thus be reprioritized.",

AB  - Pravo na pristup ekološkoj informaciji jeste jedno od procesnih prava
kojim se realizuje pravo svakog pojedinca da živi u „životnoj sredini koja odgovara
njegovom zdravlju i blagostanju“. Arhuska konvencija utvrđuje samo osnove primene
ovog prava, ostavljajući Stranama potpisnicama bliže uređenje. Nacionalni
pravni okvir koji određuje na koji način se utvrđuju naknade za pristup ekološkim
informacijama nekonzistentan. Sud pravde Evropske unije je u slučaju East Sussex
County Council protiv Information Commissioner doneo odluku u kojoj se utvrđuju
kriterijumi na osnovu kojih se može odrediti „razuman iznos” za pružanje
ekoloških informacija u konkretnom slučaju. U radu se ukazuje na domaću praksu
utvrđivanja naknade za pružanje ekološkim informacijama, moguće kriterijume
za utvrđivanje „razumnog iznosa” i uticaj visine naknade na dostupnost prava na
pristup ekološkim informacijama.
AB  - The right of access to environmental information is one of the procedural rights
which implements the right of every person of present and future generations to
live in an environment „adequate to his or her health and well-being” The Aarhus
Convention establishes the grounds for its application. National legal framework
concernig the reimbursement of costs is inconsistent. In case East Sussex County
Council v Information Commissioner the ECJ set basic standards to determine the
notion of „reasonable amount” for the provision of environmental information.
The paper points to the national practice of determining reimbursement of costs
for access to environmental information, the possible criteria for determining the
„reasonable amount” and the impact that those costs has on the availability of the
right of access to environmental information.

AB  - In recent years, environmental law and pol-icy have undergone a change of governance models, shifting from central state, top-down regulation to more transparent, local decision making structures involving private companies, non-governmental organizations, concerned cit-izens and interest groups. The Aarhus Conven-tion became a part of the Serbian legal system in 2009. Its provisions not only strengthen third-par-ty rights to participate, but furthermore oblige state authorities to be active in involving citizens in environmental decisions. The question arises about the extent of consequences of this devel-opment at the international level for the national legal system.Analysis of the implementation of the Gen-eral Administrative Procedural Act (GAPA) and the Law on Environmental Protection in Serbia shows that social actors used to be allowed to participate in citizens forums and decision mak-ing in environmental matters, and their role was important only if they were directly and individu-ally concerned. This situation changed partially in 2004 with the adoption of new laws. The article examines recent cases in which the public and public concerned were not able to participate in environmental decision making, even though the law stipulated such a possibility. The article examines the consequences of implementing a new model, where representatives of collective interests would be able to infuence environmen-tal decision making, proposed by the Draft of the new GAPA.

Retriever Sverige, stao na stanovište da, radi usklađivanja određenih aspekata
autorskog i srodnih prava u informacionom društvu, Direktivu 2001/29/EZ
treba tumačiti na način da stavljanje na internet stranicu hiperlinkova na koje
je moguće kliknuti, a koji vode do dela slobodno dostupnih na drugoj internet
stranici, ne predstavlja radnju javnog saopštavanja dela. To dalje znači da za
te aktivnosti nije potrebno pribaviti ovlašćenje nosioca autorskog prava. Osim
toga, Sud Evropske unije stao je na stanovište i da države članice nemaju pravo
da pruže dodatnu zaštitu nosiocima autorskog prava određujući pojam javnog
saopštavanja šire u odnosu na određenje stipulisano Direktivom 2001/29/EZ. U
radu se ukazuje na osnove Direktive 2001/29/EZ, daje osvrt na stavove Suda
Evropske unije koji su izneti u slučaju Nils Svensson, Sten Sjögren, Madelaine
Sahlman, Pia Gadd v Retreiver Sverige AB i slučaju Sociedad General de Autores
y Editores de España (SGAE) v Rafael Hoteles SA i analizira uticaj koji oni
imaju na razvoj zaštite autorskog i srodnih prava u informacionom društvu.
AB  - In February 2014, the Court of Justice of the European Union (ECJ), decided
on a preliminary ruling in the case where journalists, who wrote press articles
that were published in the Göteborg-Posten newspapers and on the Göteborg-
Posten website, brought an action against Retriever Sverige, that operates
a website providing its clients with lists of clickable Internet links to articles published
by other newspapers. The ECJ found that the relevant articles of Directive
2001/29/EC on the harmonization of certain aspects of copyright and related
rights in the information society, must be interpreted as meaning that the provision
on a website of clickable links to works freely available on another website
does not constitute an „act of communication to the public“ as refered to in the
Article 3 (1) of this Directive. It means that the authorization of the copyright
rightholders is not required for a communication to the public. In addition, the
ECJ found that Member States are precluded from giving wider protection to
copyright rightholders by laying down that the concept of communication to the
public includes a wider range of activities than those stipulated by the Directive
2001/29/EC. The paper points out the fundamentals of Directive 2001/29/EC,
considerations of the ECJ of the questions reffered in in the case of Nils Svensson,

AB  - U radu se razmatra mogućnost primene Vanrednog ukidanja rešenja kao vanredne mere zaštite prava na život u zdravoj životnoj sredini. Autor analizira pravnu prirodu Vanrednog ukidanja rešenja, prikazuje uslove za njegovu primenu i objašnjava posebnost primene ovog vanrednog pravnog sredstva u stvarima od značaja za zaštitu životne sredine. S ciljem pronalaženja osnovnih kriterijuma za utvrđivanje značenja koje se kod primene Vanrednog ukidanja pridaje pojmovima 'javni interes' i 'teška i neposredna opasnost po zakonom utvrđeni interes' i definisanja odnosa između javnog interesa i interesa zaštite životne sredine, naročita pažnja posvećena je analizi prakse Ustavnog suda Srbije i Evropskog suda za ljudska prava. Autor iznosi argumente za primenu Vanrednog ukidanja kao poslednje pravne mere zaštite životne sredine, ukazuje na probleme koji u praksi otvaraju potrebu da se zakonito stečena prava iz integrisane i energetske dozvole, pod restriktivnim uslovima, ograniče ili čak suspenduju i ukazuje na primenu stavova sudske prakse o potrebi balansiranja između opšteg interesa zajednice i zaštite osnovnih prava pojedinaca. U zaključnom razmatranju, autor ukazuje na uočenu inkonzistentnost postojećih zakonskih rešenja koja se odnose na pitanje procesne legitimacije kod Vanrednog ukidanja u stvarima od značaja za zaštitu životne sredine i moguće pravce noveliranja.
AB  - The paper examines the possibilities of application of an Extraordinary Cancellation of Decision as the last legal measure to protect the right of every person to a healthy environment. The author analyzes the legal nature of the Extraordinary Cancellation, describes the prerequisites for its application and explains the uniqueness of its application in environmental protection. In order to find the basic elements for determining the notion of 'public interest' and 'serious and immediate threat' to interests stipulated by law and defining relations between the public interest and the interest of environmental protection, a special attention is given to Serbian Constitutional Court and ECHR case law. The author presents arguments for the application of Extraordinary Cancellation in environmental protection, points out the practical issues that justify limitation or even cancellation of rights acquired in accordance with the integrated or energy permit, and indicates the application of relevant case law on making a fair balance between demands of general community interest and requirements for individual's fundamental rights protection.

AB  - U junu 2013. godine Evropski sud za ljudska prava doneo je presudu u vezi sa
pravom na pristup informacijama o upotrebi mera elektronskog nadzora informacionih
sistema u slučaju protiv Srbije. U stručnoj javnosti su tim povodom otvorena
brojna pitanja: koji su uslovi za prikupljanje i obradu podataka o ličnosti; na koji
način se informacije mogu zadržati i ko ima pravo na pristup zadržanim informacijama;
ko i pod kojim uslovima ima pravo da vrši elektronski nadzor informacionih
sistema; kakav je odnos između prikupljanja podataka i informacije o prikupljenim
podacima; pod kojim uslovima se može pristupiti informacijama o ostvarenoj komunikaciji.
U radu se analizira geneza postojećih zakonskih rešenja i ukazuje na Odluku
Ustavnog suda Srbije o utvrđivanju nesaglasnosti Zakona o zaštiti podataka o
ličnosti sa Ustavom (IУз–41/2010 od 30. maja 2012. godine), Odluku Ustavnog suda
Srbije o utvrđivanju nesaglasnosti Zakona o Vojnobezbednosnoj agenciji i Vojnoobaveštajnoj
agenciji sa Ustavom (IУз–1218/2010, od 19. aprila 2012. godine), Odluku
Ustavnog suda Srbije o utvrđivanju nesaglasnosti Zakona o elektronskim komunikacijama
sa Ustavom (IУз–1245/2010, od 8. jula 2013. godine).
AB  - The European Court of Human Rights has recently delivered a judgement
in the case of the right to access public information related to interception of
electronic communications concerning the implementation of Article 10 of the
Convention in Serbia. This judgement has opened a number of questions: under what conditions the personal data may be processing and collected; under what
conditions interception of electronic communications is lawful; who has the authority
to access to those information; who has the authority to demand the interception
on electronic communications; what relation does it exist between the
data collection and the information on it? The paper analyzes development of
legal framework concerning the right to privacy and interception of electronics
communications and points out the Decision of Serbian Constitutional Court
on the Proposal to review the constitutionality of provisions of the Law on data
protection (IУз–41/2010, from May 30, 2012.), the Decision of Serbian Constitutional
Court on the Proposal to review the constitutionality of provisions
of the Law on Military Security Agency and Military Intelligence Agency (IУз–
1218/2010, from April 19, 2012), and the Decision of Serbian Constitutional
Court on the Proposal to review the constitutionality of provisions of the Law
on electronic communications (IУз–1245/2010, from July 8, 2013).

AB  - Osnovni cilj formulisanja i primene mera nuklearne sigurnosti i bezbednosti
jeste zaštita ljudi i životne sredine od štetnog dejstva jonizujućeg zračenja.
Da bi se obezbedili uslovi za kvalitetno i efikasno sprovođenje mera nuklearne
sigurnosti, neophodno je uspostaviti sistem ekoloških dozvola. U radu se ukazuje
na sistem izdavanja ekoloških dozvola u Srbiji, uz uporedni prikaz rešenja
u zakonodavstvu Francuske i Nemačke. Na važnost pravilno uređene i ekološki
zdrave upotrebe nuklearne energije ukazano je u IAEA Konvenciji o nuklearnoj
sigurnosti. U radu se ukazuje na mogućnost implementacije Konvencije o
nuklearnoj sigurnosti u pravni sistem Srbije, naročito sa aspekta novina koje
sadrži Predlog zakona o izmenama zakona o zaštiti od jonizujućih zračenja i o
nuklearnoj sigurnosti.
AB  - The main objective of nuclear safety and security law formulation and implementation
is the protection of people and environment from harmful effects
of ionizing radiation. A system of environmental permits should be established
to provide conditions for efficient and effective implementation of nuclear safety
law. The paper points out the environmental permitting system in Serbia and
a comparative review of the solutions in French and German Environmental
law. The IAEA Convention on Nuclear Safety contains the world’s first binding
international standards on the siting, design, construction and operation
of land-based nuclear power plants. The Convention also includes an international
review system to supervise the implementation of these provision. The
paper analyze the possibility of its implementation in the Serbian legal system,
particularly from the point of the Draft Law on Ionizing Radiation Protection
and Nuclear Safety.

AB  - Odgovor na pitanje o (ne)opravdanosti uvođenja genetički modifikovanih
organizama (GMO) zahteva multidisciplinaran pristup i učešće stručnjaka sa
područja zaštite zdravlja ljudi, zaštite životne sredine, poljoprivrede, zaštite
prirode, kao i javnosti. Pri tome, ključno pitanje jeste formulisanje konzistentnog
zakonskog okvira koji će omogućiti da namerno uvođenje GMO u životnu
sredinu bude bezbedno po zdravlje ljudi i stanje životne sredine. U radu se
analizira regulativa Evropske unije (EU) kojom je uređeno ovo pitanje – Direktiva
2001/18/EC o namernom uvođenju u životnu sredinu genetički modifikovanih
organizama i Preporuka Evropske komisije 2003/556/EC o vodičima
za razvoj nacionalnih strategija i najbolje prakse za osiguranje suživota genetički
modifikovanih useva sa konvencionalnim i organskim uzgojem, Direktiva
2009/41/EC o ograničenoj upotrebi genetički modifikovanih mikroorganizama
(GMMO), Uredba (EC) br. 1830/2003 o sledljivosti i označavanju GMO i sledljivosti
prehrambenih proizvoda i hrane za životinje proizvedene od GMO. U
radu se ukazuje na stepen usaglašenosti novog Zakona o genetički modifikovanim
organizmima i standarda utvrđenih na nivou EU.
AB  - The answer to the question of (un)justification of the introduction of GMOs
requires multi-disciplinary approach and the participation of experts from the
area of human health protection, environmental protection, agriculture, nature
conservation and public. In doing so, the key issue is the formulation of a consistent
legal framework that will ensure eventual deliberate realise of GMOs
into the environment to be safe for human health and the environment. The
paper analyzes the EU regulations governed this issue (Directive 2001/18/EC on
the deliberate release into the environment of genetically modified organisms,
Commission Recommendation 2003/557/EC on guidelines for the development
of national strategies and best practices to ensure the coexistence of genetically
modified crops with conventional and organic farming, Directive 2009/41/EC on the contained use of genetically modified micro-organisms; Regulation (EC)
no. 1830/2003 concerning the traceability and labelling of genetically modified
organisms and the traceability of food and feed products produced from genetically
modified organisms). The paper indicates the degree of conformity of the
new Law on Genetically Modified Organisms and the standards established at
EU level.

abstract = "Odgovor na pitanje o (ne)opravdanosti uvođenja genetički modifikovanih
organizama (GMO) zahteva multidisciplinaran pristup i učešće stručnjaka sa
područja zaštite zdravlja ljudi, zaštite životne sredine, poljoprivrede, zaštite
prirode, kao i javnosti. Pri tome, ključno pitanje jeste formulisanje konzistentnog
zakonskog okvira koji će omogućiti da namerno uvođenje GMO u životnu
sredinu bude bezbedno po zdravlje ljudi i stanje životne sredine. U radu se
analizira regulativa Evropske unije (EU) kojom je uređeno ovo pitanje – Direktiva
2001/18/EC o namernom uvođenju u životnu sredinu genetički modifikovanih
organizama i Preporuka Evropske komisije 2003/556/EC o vodičima
za razvoj nacionalnih strategija i najbolje prakse za osiguranje suživota genetički
modifikovanih useva sa konvencionalnim i organskim uzgojem, Direktiva
2009/41/EC o ograničenoj upotrebi genetički modifikovanih mikroorganizama
(GMMO), Uredba (EC) br. 1830/2003 o sledljivosti i označavanju GMO i sledljivosti
prehrambenih proizvoda i hrane za životinje proizvedene od GMO. U
radu se ukazuje na stepen usaglašenosti novog Zakona o genetički modifikovanim
organizmima i standarda utvrđenih na nivou EU., The answer to the question of (un)justification of the introduction of GMOs
requires multi-disciplinary approach and the participation of experts from the
area of human health protection, environmental protection, agriculture, nature
conservation and public. In doing so, the key issue is the formulation of a consistent
legal framework that will ensure eventual deliberate realise of GMOs
into the environment to be safe for human health and the environment. The
paper analyzes the EU regulations governed this issue (Directive 2001/18/EC on
the deliberate release into the environment of genetically modified organisms,
Commission Recommendation 2003/557/EC on guidelines for the development
of national strategies and best practices to ensure the coexistence of genetically
modified crops with conventional and organic farming, Directive 2009/41/EC on the contained use of genetically modified micro-organisms; Regulation (EC)
no. 1830/2003 concerning the traceability and labelling of genetically modified
organisms and the traceability of food and feed products produced from genetically
modified organisms). The paper indicates the degree of conformity of the
new Law on Genetically Modified Organisms and the standards established at
EU level.",

Public administration and e-government in Serbia

AB  - In the context of a knowledge-based economy, the concept of e-government is taking effect in terms of efficiency, effectiveness, as well as in meeting the needs of democratic transition. Introducing e-government is an integral part of widespread public administration reforms that include 'redefining' government. The main premise of e-government is that government information and services must be equally accessible to all citizens. Access to vital government information and rendering on-line public services (e.g. issuing permits, personal documents, submitting applications etc) by an 'open government' is creating a new quality of public services. Due to this technical aspects of introducing e-government must seriously consider legal issues that arise from the new information and knowledge-based communication between government and citizen. In this model, the status of citizens as 'customers' of e-government public services is prerequisite.

AB  - Afirmaciju prava na učešće javnosti u procedurama od značaja za zaštitu životne sredine moguće je postići stvaranjem adekvatnih mehanizama za prikupljanje i analizu informacija o stanju u životnoj sredini, kao i poveravanjem ovlašćenja za pristup tim informacijama stručnjacima i široj javnosti. Imajući u vidu naša važeća zakonska rešenja u oblasti zaštite životne sredine, može se uočiti da regulativa informisanja javnosti o fazama postupka i mogućnostima aktivnog učešća javnosti nije konzistentna. U radu se analizira pojam, normiranje i pravna zaštita učešća javnosti u procedurama od značaja za zaštitu životne sredine u okvirima naših važećih ekoloških zakona, kao i onih čije usvajanje predstoji. Osim toga, rad obrađuje i osnovne postavke Arhuske konvencije o dostupnosti informacija, učešću javnosti u donošenju odluka i prava na pristup pravdi (pravnu zaštitu) u pitanjima životne sredine.
AB  - The ideas of environmental and social justice imply the possibility of efficient access to administrative and judicial legal remedies in the field of health and environmental protection. The authors examine administrative and administrative-judicial legal protection of public participation in the matters of environmental protection in Serbia, and conclude that current European tendencies are not accepted to the full extent - both in Serbian legislation and in practice. The necessity of reliable legal protection and access to justice in environmental matters in Serbia - and especially the need for protection of the right to public participation in environmental matters - call for ratification of the Aarhus Convention, and for harmonizing Serbian law with it.
