An early critique of Kelsens pure theory of law: Slobodan Jovanović on the basic norm and primacy of international law

AB  - The keystone of Kelsen s Pure Theory of Law is his doctrine of the basic norm. The basic norm is therefore the subject of Jovanović s critique of Kelsen s entire theory. According to Kelsen, the basic norm precedes the authority of a state, since it is positioned between the factual social force, which establishes the authority of the state, and the state. According to Jovanović, there is neither the law without a state, nor a state without the law; hence neither can Kelsenian legal norm, perceived as a norm prior to the state, be a positive legal norm, but an abstract, natural law norm. Jovanović discusses and criticizes Kelsen s solution to the problem of the relationship between national and international law, which depends on the establishment of the basic norm.

AB  - Središte misli Slobodana Jovanovića je teorija države koja povezuje njegovo celokupno delo u jedan jedinstven sistemski okvir. Zbog toga su sva pitanja kojima se bavio, uključujući i razmatranje odnosa politike i morala, u bližoj ili daljoj vezi sa njegovom teorijom države. U radu se istražuju moguća razrešenja protivrečnih makijavelističkih i platonističkih stanovišta o državi koja su ponuđena u Jovanovićevom učenju. Državni organ deluje moralno ako izvršava volju državno-pravne ličnosti, a ne svoju ili bilo koju volju tuđu državi. Pri tome, država se iz sopstvenog interesa samoograničava podelom vlasti i donošenjem zakona, što omogućuje ostvarivanje slobodne zajednice neophodne za jačanje moralnosti u državi. Izjednačavanje moralnosti i političke praktičnosti u dalekovidom utilitarizmu engleskog političkog iskustva, koje se nalazi u osnovi Berkove političke filozofije, može biti svojevrsna sinteza makijavelističkog i platonističkog učenja o državi.
AB  - The core of Slobodan Jovanovićs reflections is the theory of state, which ties his complete oeuvre into a single system framework. This is why the issues he dealt with, including considerations of the relations between politics and morality, are closely or loosely connected to his theory of state. This paper explores possible solutions to the contradictory Machiavellian and Platonist viewpoints of state put forward in Jovanovićs scholarship. State organ acts morally if executing the will of a state, not its own or any other will alien to the state. With that, the state limits itself for its own interests by separation of power and passage of laws, which provides creation of free community necessary for reinforcement of morality in the state. The equation mark between morality and political practicality in the far-sighted utilitarianism of the English political experience, underlying Burkes political philosophy, could be a synthesis sui generis of Machiavellian and Platonist ideas of state. In that, Jovanović does not deem state to be the highest ideal, as he points to the existence of values above the state.
