Supružnik kao naslednik prvog naslednog reda u uporednom pravu

Abstract

U prvom naslednom redu kao naslednici se uvek javljaju ostaviočevi potomci, dok ostaviočev supružnik može nasleđivati ili istovremeno s njima i dobiti deo zaostavštine u svojinu, ili pak, dobiti samo pravo udovičkog užitka na delu zaostavštine. Autor analizira kako je u francuskom, austrijskom, nemačkom, švajcarskom i engleskom pravu uređen naslednopravni položaj supružnika u prvom naslednom redu, da bi na kraju uporedio dobre i loše strane svakog od pomenutih rešenja.

Descendants of fathers with another woman have priority in inheriting while their spouses can share inheritance with them or get the right to widow's enjoyment of part of the inheritance. The author analyzes the French, Austrian, German, Swiss and English law related to the inheritance position of spouses in the first inheritance circle, so that at the end he would compare good and bad sides of every mentioned solution.
