Od soka do zaštićenog svedoka

From sok to protected witness

Abstract
Savremene nedoumice u vezi sa zaštićenim svedocima poslednjih godina su pobudile naročito interesovanje u domaćoj procesnopravnoj teoriji i praksi. Zbog toga se u ovom radu istražuje postojanje elemenata srpskog običajnog prava u savremenom procesnom zakonodavstvu Srbije. Naime, ističe se postojanje ustanove soka - zaštićenog (tajnog) svedoka, rasprostranjene u običajnim pravima mnogih slovenskih naroda. To će biti polazna osnova za ispitivanje u kolikoj meri ova savremena procesnopravna ustanova ima veze sa onom iz slovenske pradavnine. Zatim se analizira primena ovog dokaznog sredstva u srpskom srednjovekovnom procesnom pravu. Najviše naučne građe o tome pruža sudska praksa Dubrovačke republike iz XV i XVI veka, gde se u spisima sa sudskih procesa, u kojima su učestvovali Srbi iz zaleđa, uočava često korišćenje ovog dokaznog sredstva. Ova procesnopravna ustanova održala se u pravnom životu Srba u Crnoj Gori, Hercegovini i Boki sve do kraja XIX veka. Na kraju, uporednom analizom savre...mene pravne ustanove zaštićenog svedoka i soka kao ustanove (starog srpskog) običajnog prava, biće ukazano na činjenicu da su se nekadašnji i sadašnji pravosudni sistemi suočavali sa istim problemima povodom zaštite svedoka, kao i da su ih rešavali na veoma sličan način.

This paper puts forward a comparative analysis that indicates the existence of some elements of the old customary law in contemporary Serbian criminal procedure. Historically, the institution of sok - the protected witness - was known to the common laws of many Slavic peoples. Most of the material regarding this institution is preserved in the court archives of the Republic of Dubrovnik, as it used to apply old Serbian customary law in cases when the Serbs were involved in a case. The institution of sok existed in some of the regions populated by Serbs, such as Montenegro, Herzegovina and Boka. By the end of the XIX century, as the state and the organized judiciary gain their strength, the institution of sok disappeared. With the rise of organized crime in Serbia in the late twentieth century, the need for a protected witness arose. Many of the present-day provisions regarding the institution of protected witness bear resemblance to the old customary rules on sok, manifesting clearly h...ow the same problems were solved in a similar way in different times and circumstances.
