Tužilački saveti i garancija tužilačke autonomije u državama Zapadnog Balkana

Abstract

Prošlo je više od pet godina od osnivanja pravosudnih i tužilačkih saveta u državama Zapadnog Balkana. Novoosnovane institucije preuzele su nadležnosti u izboru, napredovanju i razrešenju javnih tužilaca u skladu sa međunarodnim standardima zaštite nezavisnosti pravosuđa, pa se nameće pitanje u kojoj meri su tužilački saveti ispunili očekivanja stručne javnosti. U tekstu se analiziraju evropski standardi i dobre prakse uređenja pravosudnih saveta, kao i uporednopravna rešenja u državama Zapadnog Balkana i njihova usklađenost sa standardima.

More than five years ago judicial and prosecutorial councils were established in the Western Balkans countries. Newly established institutions took over jurisdiction related to the election, promotion and dismissal of public prosecutors in line with the international standards of judicial independence. It is necessary to assess whether the prosecutorial councils fulfilled professional public expectations. In the paper author analysed European standards and good practices of prosecutorial councils regulations, as well as comparative law models in Western Balkans countries and their compliance with standards.
