Novi Zakon o javnom okupljanju : delimično izvršenje Akcionog plana za Poglavlje 23

Abstract

Акционим планом за Поглавље 23 предвиђено је доношење Закона о јавном окупљању. У овом раду анализира се усклађеност решења новог За- кона о јавном окупљању са европским стандардима. У раду су представље- ни улога Уставног суда Србије у стављању ван снаге Закона о окупљању грађана и примедбе које је Уставни суд изнео о том закону. Дата је ана- лиза регулисања поступка правне заштите слободе окупљања. Аутор представља прве примере из праксе као аргумент да је Закон о јавном окупљању остао недоречен у регулисању правне заштите.

Action Plan for Chapter 23 provides for the adoption of the Law on Public Assembly. This paper analyzes the compliance of solutions in the new Law on Public Assembly with European standards. This paper presents the role of the Constitutional Court of Serbia in the abrogation of the Law on Public Assembly (1992), as well as remarks by the Constitutional Court stated on this Law. It gives the analysis of regulation of the procedure of legal protection of freedom of assembly. The author presents the first examples as an argument that the Law on Public Assembly in the regulation of legal protection, remained vague.
