dc.description.abstract | Segregacija u ustanovama obrazovnog sistema još uvek postoji u mnogim evropskim zemljama, pa i u Srbiji. Žrtve segregacije su najčešće učenici romske nacionalnost i učenici sa invaliditetom, ali i učenici iz drugih ugroženih društvenih grupa. Iako je segregacija zabranjena međunarodnim i domaćim antidiskriminacionim propisima i javnim politikama, de facto postoje segregisane škole i segregisana odeljenja u okviru škola. Za uspešnu eliminaciju segregacije potrebno je raspolagati relevantnim podacima i na osnovu njih kreirati adekvatne mere. Prikupljanje podataka o nacionalnoj pripadnosti učenika, kao naročito osetljivih podataka, podleže posebnom pravnom režimu. Ipak, standardi ljudskih prava ne isključuju prikupljanje ovih podataka, ali pod uslovima koji su iscrpno navedeni, odnosno ukoliko su namenjeni određenim ciljevima i ukoliko postoje jasne garancije zaštite. Nepostojanje adekvatnih evidencija u sistemu obrazovanja i vaspitanja u značajnoj meri otežava donošenje i sprovođenje mera i propisa koji za cilj imaju socijalnu inkluziju, onemogućava statističke dokaze u postupcima pred nadležnim organima, kao i sprovođenje obaveza koje proizlaze iz međunarodnih dokumenata i procesa evropskih integracija. | sr |
dc.description.abstract | Segregation in education institutions remains to exist in many European countries, including Serbia. Victims of segregation are mostly Roma students and students with disabilities, but also pupils from other vulnerable social groups. Although segregation is prohibited by international and domestic anti-discrimination laws and public policies, there are de facto segregated schools and segregated classes within the schools. In order to eliminate segregation, it is necessary to provide relevant data and to create adequate evidence-based measures. Collection of data on students nationality, as particularly sensitive data, is subject to a special legal regime. However, human rights standards do not exclude the collection of these data, but conditions for collection are enumerated in detail and they should be intended to specific purposes with clear guarantees protection. The lack of adequate records in educational system significantly impedes the adoption and implementation of measures and regulations aimed at social inclusion, prevents statistical evidence in proceedings before the competent authorities, as well as the fulfillment of obligations from international documents and European integration process. | sr |
