Abstract

У свим савременим правним системима, међуна- родни правни документи, односно стандарди прописани у њима имају важну и веома често незаобилазну улогу. За положај лица лишених слободе и њихова права посебно је значајан један такав документ - то је Европска конвенција о спречавању мучења и не- човјечних или понижавајућих поступака и кажњавања. Ради се о правно обавезујућем документу, уговору о људским правима, од- носно међународном инструменту који је данас достигао скоро универзалну ратификацију. То је и акт који обавезује државе потписнице Конвенције на предузимање свих одговарајућих законо- давних, административних, социјалних и образовних мјера ради заштите ове категорије лица.

In all modern legal systems, international legal documents, i.e. the standards prescribed thereof, play an important and often inevitable role. One such document is particularly important for the position of persons deprived of their liberty and their rights – the European Convention on the Prevention of Torture and Inhuman or Degrading Treatment and Punishment. It is a legally binding document, a treaty on human rights, that is, an international instrument that has reached almost universal ratification nowadays. It is also an act that obliges the signatory states of the Convention to undertake all appropriate legislative, administrative, social and educational measures for the protection of this category of persons.
