Abstract
Susedsko pravo, s jedne strane kao stvarno pravo na tuđoj stvari, a s druge strane kao ograničenje prava svojine u privatnopravnom interesu, kod nas nije pozitivnopravno regulisano. Imajući u vidu značaj ovog prava, koje sve više gubi karakteristiku 'ruralnog' prava i koje će, s obzirom na svoj sadržaj i prirodu, dobijati sve veći značaj sa ekonomskim razvojem društva koji neminovno dovodi do potrebe regulisanja susedskih odnosa nastalih na temelju sveukupnog razvoja, posebno u gradovima, stvara se potreba da ono i u Republici Srbiji bude zakonski detaljno regulisano. Susedsko pravo je danas regulisano u svim modernim građanskim zakonicima. Uz zakonsko regulisanje susedskog prava nameće se i potreba njegovog jasnog razgraničenja od stvarnih službenosti.
Neighbor right, the real right to another’s property on one hand, and limitation of property right in an private interest, on the other, is not regulated in a lawfully positive manner. Given the importance of this right which increasingly loses the characteristic of 'rural' law and which will, considering its contents and nature, gain in importance with the economic development of the society that makes it necessary to regulate the neighboring relations emerging from the basis of an overall development, especially in the cities, there is a need that this right should be legally regulated in detail in the Republic of Serbia too. Neighbor right is today regulated in all modern civil codes. In addition to the legal regulation of the neighbor right, there is a need that it should be clearly demarcated as regards the real servitude.
