AB  - Spoljnotrgovinska arbitraža u Beogradu predstavlja jedno od velikih i trajnih dela koja su ostala iza profesora Mihaila Konstantinovića. On je bio jedan od glavnih proponenata njenog osnivanja i njen prvi predsednik. U tom svojstvu, bio je u prilici da usmerava rad Spoljnotrgovinske arbitraže tako da ona što pre dobije poverenje privrednih subjekata i izgradi autoritet i u zemlji i u inostranstvu. Statistike potvrđuju da se beogradska Arbitraža veoma brzo svrstala među vodeće svetske arbitražne institucije i da je postala uticajna i na nacionalnom i na međunarodnom planu. U radu se predstavljaju i analiziraju različiti načini na koje je profesor Konstantinović animirao rad Spoljnotrgovinske arbitraže i njenim uspešnim rukovođenjem započeo moderno doba razvoja jugoslovenskog i srpskog arbitražnog prava.
AB  - The Foreign Trade Court of Arbitration in Belgrade is one of the historic landmarks left behind by Mihailo Konstantinović. Professor Konstantinović was one of the main proponents of the establishment of this institution and he served as its first president. In that capacity he was in a position to steer the work of the FTCA so that it gained the trust of the business community as quickly as possible and became a reputable arbitral institution both in Yugoslavia and abroad. Records show that the Belgrade Court of Arbitration soon became a leading arbitral institution worldwide and its influence spread far beyond the Yugoslav market. The article presents and analyzes different methods and instruments that Professor Konstantinović used to develop the FTCA and shows how the successful establishment of this institution brought arbitration in Yugoslavia and Serbia into the modern era.

Uloga principa ex aequo et bono u ICSID arbitraži

AB  - Ovaj rad ispituje ulogu principa ex aequo et bono u arbitraži pred Međunarodnim centrom za rešavanje investicionih sporova (ICSID Centrom). Autor najpre uočava da je broj predmeta u kojima su stranke ugovorile primenu principa ex aequo et bono izuzetno mali. Ipak, uprkos njihovoj malobrojnosti, ovi predmeti omogućavaju izvođenje određenih zaključaka u pogledu načina na koji su stranke ugovarale odlučivanje po pravičnosti i postupanja arbitražnih veća u takvim okolnostima. Posebno se razmatraju dva scenarija: primena ex aequo et bono kao merodavnog pravnog okvira za rešavanje spora i pozivanje na ex aequo et bono u pokušaju da se isposluje poništaj arbitražne odluke. Autor zaključuje da se oprez stranaka u pogledu ugovaranja odlučivanja po pravičnosti može objasniti strahom od nedovoljne predvidljivosti ishoda spora, što je nužna posledica mehanizma primene pravičnosti kao izvora prava. S druge strane, može se očekivati da će stranke nastaviti da pokazuju kreativnost u pokušaju da dokažu da pogrešna primena merodavnog prava u meritornom postupku pred arbitražnim većem zapravo predstavlja neovalšćeno odlučivanje ex aequo et bono, čime bi se otvorio put za poništaj takve arbitražne odluke zbog prekoračenja ovlašćenja arbitražnog veća.
AB  - This article examines the role of the principle of ex aequo et bono in arbitration before the International Centre for Settlement of Investment Disputes (ICSID). At the outset, the author remarks that the cases in which the application of ex aequo et bono was agreed upon by the parties are very scarce. Nevertheless, despite that scarcity, it is possible to draw some conclusions on the way in which equity was invoked by the parties and applied by the ICSID tribunals. Two scenarios are analyzed in particular: the use of ex aequo et bono as the applicable framework for dispute settlement and the reliance on ex aequo et bono in an attempt to nullify the award before an ad hoc Committee. The author concludes that the reluctance of the parties to agree on ex aequo et bono may be explained by the lack of predictability of outcomes that is inherent to this source of law. On the contrary, it might be expected that the parties will continue trying to come up with creative arguments aimed at proving the unauthorized application of ex aequo et bono by the tribunals in their attempts to annul the awards on the basis of excess of powers.

AB  - Pandemija korona virusa nametnula je velike izazove u svim sferama života, pa tako i u pravu. Pravne norme su morale da se prilagode tzv. "novoj normalnosti" i reše mnoga sporna pitanja koja je pandemija nametnula. U ovom radu autori razmatraju jedan specifičan vid uticaja pandemije na privredno pravo - dobrovoljno ograničenje slobode transfera sredstava, do koga je, u Republici Srbiji, došlo stupanjem na snagu nekoliko uredaba i zakona usvojenih u sklopu pokušaja umanjivanja ili otklanjanja štetnih posledica pandemije na poslovanje privrednih subjekata. Institut dobrovoljnog ograničenja slobode transfera sredstava ispitan je sa stanovišta kompanijskog i prava stranih ulaganja. Nakon analize zabrane isplate dobiti, autori zaključuju da je u uslovima pandemije donošenje nestandardnih mera nužno; da se ove mere moraju donositi brzinom koju diktira pandemija, ali da prilikom njihovog formulisanja ipak treba voditi računa da dugoročna šteta ne nadvlada kratkoročnu dobit.
AB  - Corona virus pandemic posed great challenges in all spheres of life. Quite naturally, law had to face those challenges, adapt to the "new normal" and bring viable solutions to many problems created by the pandemic. In this paper the authors focus on one specific manifestation of the influence of pandemic on business law - voluntary abstention of business entities from enjoying free transfer of funds. In the Republic of Serbia, this abstention came to effect with entry into force of several laws and bylaws enacted with the aim of neutralizing the negative consequences of the pandemic on economy and business. The voluntary abstention is analysed from the standpoint of company law and the rules on protection of foreign direct investment. After evaluating the prohibition on profit distribution to shareholders, the authors conclude that the enactment of atypical, non-standard measures is necessary during the pandemic and that these measures need to be adopted promptly enough to timely address the problems that they are supposed to solve, but during their enactment one must bear in mind that the short-term benefits should not be off set by long-term damage.

AB  - Autor se u ovom radu bavi analizom glavnih odredaba nedavno zaključene Konvencije o međunarodnim poravnanjima proizašlim iz medijacije (Singapurske konvencije). Posebna pažnja je posvećena jednom posebno inovativnom elementu Konvencije - konceptu funkcionalnog priznanja ugovora o poravnanju, koji je ključan za razumevanje principa olakšanog izvršenja poravnanja. Premda se može naslutiti da će se na ovaj način medijacija učiniti još atraktivnijom metodom alternativnog rešavanja međunarodnih trgovinskih sporova, jer će se olakšanim izvršenjem poravnanja vreme i troškovi rešavanja sporova smanjiti, postoji velika opasnost da ovaj koncept u praksi dovede do velikih teškoća, čije bi razmere i ozbiljnost mogle ozbiljno da ugroze održivost pravnog okvira za medijaciju koji Singapurska konvencija ima ambiciju da uspostavi. Kako bi se te teškoće izbegle, potrebno je da dođe do temeljne reforme kako unutrašnjeg, tako i međunarodnog pravnog okvira za medijaciju u trgovinskim sporovima sa elementom inostranosti.
AB  - This paper offers an analysis of the key provisions of the recently concluded Convention on International Settlement Agreements Resulting from Mediation (the Singapore Convention). A special attention is given to a particularly innovative element of the Convention - the so-called functional recognition of the settlement agreements. This concept is crucial for the overall understanding of the new mechanism that the Singapore Convention seeks to introduce. Although it may be assumed that the adherence to the functional recognition approach is likely to decrease the costs and reduce the time necessary for resolution of international commercial disputes, it is also prone to inducing many problems susceptible of jeopardizing the long-term sustainability of the system that the Singapore Convention aspires to establish. In order to avoid those problems, national and international sources of law applicable to commercial mediation should be fundamentally revisited and reformed.

AB  - Iako je postupak pristupanja Svetskoj trgovinskoj organizaciji veoma složen i zahtevan, njega suštinski uređuje samo jedna odredba Sporazuma o osnivanju STO, dok je od posrednog značaja za ovo pitanje još nekoliko odredaba tog sporazuma. U takvoj situaciji, mnogi aspekti postupka pridruživanja uređeni su praksom koja, koliko God da je do sada bila generalno homogena, ipak pokazuje određene značajne izuzetke i odstupanja u pojedinim slučajevima. Imajući u vidu takvo stanje prava u pogledu uređenja okvira pristupanja STO, ovaj rad detaljno razmatra pravne izvore merodavne za postupak pristupanja, objašnjava i analizira postupak pristupanja i način definisanja materijalnopravnih uslova pristupanja i upoređuje ih sa opštim međunarodnopravnim standardima pristupanja međunarodnim organizacijama. Zaključuje se da neodređenost propisa koji definišu pravni okvir pristupanja STO sa jedne strane omogućava Organizaciji i kandidatu fleksibilnost i otvara put za iznalaženje uslova pristupanja koji će u najvećoj meri odgovarati prilikama, potrebama i mogućnostima kandidata ali i da, sa druge strane, TA neodređenost može da stvori pravnu nesigurnost kako na strani kandidata, tako i na strani Organizacije. Premda bi nešto preciznije postavljanje uslova pristupanja verovatno bilo od koristi preostalim kandidatima za članstvo, barem u pogledu poboljšanja pravne sigurnosti i povećanja predvidljivosti toka i ishoda pregovora o pristupanju, veoma je malo verovatno da će Organizacija promeniti svoju praksu u ovom pogledu, koja je suštinski ostala ista još iz vremena primene GATT-a 1947.
AB  - Despite its remarkable complexity, the process of accession to the World Trade Organization is essentially governed by only one provision of the Agreement Establishing the World Trade Organization. Additionally, a few more provisions of the said Agreement bear indirect impact on the issue of accession. Consequently, many aspects of the accession process are governed by practice which, as homogenous as it may be, nevertheless shows certain exceptions in some cases. Thus, this paper presents the sources of law for the accession to the WTO, explains and analyzes the accession process and the way in which the substantive requirements for the accession (i.e. the terms of accession) are defined and contrasts them to the general standards of accession to international organizations. The author concludes that the lack of precision of the provisions governing the accession gives a possibility to the Organization and to the candidate to be flexible in defining the terms of accession that will best fit the situation, the needs and the economic capabilities of the candidate. However, that lack of precision may also jeopardize the principle of legal certainty and foreseeability of the development of the accession process, as well as of its outcomes. Although it could be argued that more precision in defining the legal framework to the accession to the WTO could prove to be beneficial for the remaining candidates, it is highly unlikely that the current practice will be amended as it is more or less consistently applied since the times of GATT 1947.

AB  - Razlike trgovinske i investicione arbitraže tokom poslednje decenije značajno zaokupljaju pažnju pravne nauke i prakse. Faktor koji naročito otežava proučavanje razlika trgovinske i investicione arbitraže jeste okolnost da je i sama klasa investicionih arbitraža veoma heterogena, jer pravni osnov spora između ulagača i države može biti različit: direktan ugovorni odnos ulagača i države, međunarodni investicioni sporazum, unutrašnji propis o zaštiti ulaganja itd. U ovom radu autor predstavlja i razmatra nekoliko odabranih tačaka razlikovanja navedene dve vrste arbitraže, i to: zaključenje arbitražnog sporazuma, merodavno materijalno pravo, princip javnosti, odnosno nejavnosti postupka i kontrolu, priznanje i izvršenje arbitražne odluke. Zaključuje se da su izložene razlike posledica prilagođavanja procesnopravnog okvira posebnostima ulaganja kao pravnog posla, ali i da te razlike mogu imati značajanuticaj na ishod spora. Zato je potrebno izboru merodavnog arbitražnog mehanizma rešavanja investicionih sporova pristupiti sa dužnom pažnjom i oprezom.
AB  - Over the last decade, the differences between commercial and investment arbitration have been in the focus of attention of both scholars and practitioners. Particular challenges in approaching this matter stem from the fact that investment arbitration alone is a very diversified category, since investment disputes may arise from various legal grounds: direct contract between teh investor and the State, international investment treaty, internal regulations on investment protection, etc. This paper presents and analyzes several points of divergence between commercial and investment arbitration: conclusion of the arbitration agreement, applicable substantive law, the principles of transparency or privacy and the control over the arbitral award. It may be concluded that the said differences are caused by the aspiration to better adapt the rules of arbitration procedure to the specificities of investment as a legal transaction. On the other hand, these differences may have a significant impact on the outcome of the dispute, so it is highly advisable to exercise special attention and due care when opting for a specific arbitral mechanism for resolution of investment disputes.

AB  - Predmet rada predstavlja analizu obaveze poverljivosti u međunarodnim poslovnim ugovorima zaključenim od strane države. U posebnom fokusu je tendencija pomeranja do sada dominantnog principa poveriljivosti ka principu transparentnosti, koja naročito dolazi do izražaja poslednjih godina. Obaveza poverljivosti može da bude ustanovljena kako u pogledu podataka i informacija koji proističu iz ugovora ili su u vezi sa njim, tako i u pogledu pojedinih aspekata rešavanja sporova iz tog ugovora. Dok princip poverljivosti i dalje dominira u pogledu podataka i informacija koji proističu iz ugovora ili su u vezi sa njim, dotle se princip transparentnosti u poslednje vreme sve češće uspostavlja u fazi rešavanja sporova. To naročito dolazi do izražaja u oblasti rešavanja sporova između ulagača i države prijemnice ulaganja, a koji proističu iz povrede međunarodnog sporazuma o zaštiti ulaganja. Razlog za uvođenje i jačanje principa transparentnosti u međunarodnim poslovnim ugovorima zaključenim od strane države ogleda se u prisustvu javnog interesa, koji inače, nije karakterističan za poslovne odnose između 'čisto' komercijalnih ugovornih strana. Ipak, kako se i u poslovnim ugovorima zaključenim od strane države obaveza poverljiivosti najčešće uspostavlja slobodnom voljom ugovornih strana, one bi ovom pitanju trebalo da pristupe oprezno i svrsishodno. U tom smislu, ugovornim stranama od značajne pomoći mogu biti modeli klauzula i sporazuma o poverljivosti izrađeni od strane međunarodnih organizacija.
AB  - This paper analyses the issue of confidentiality in international business contracts concluded by a state and explores the shift from confidentiality to transparency emerging in recent years. Confidentiality obligation may be established with respect to information arising out of or connected to the contract, or with respect to the elements of the dispute settlement mechanism. While the principle of confidentiality still predominantly governs the information arising out of or connected to the contract, the dispute settlement system gradually becomes much more permeable to the principle of transparency. This is particularly true for the treatybased investor-state arbitration, whose legal framework has undergone significant changes over the last decade. The reason for the emergence of the principle of transparency in international business contracts concluded by a state lies in greater public interest. Still, confidentiality obligation is most often included in international business contracts concluded by a state by free will of contracting parties, and the parties to the contract are encouraged to use this possibility. To that effect, they may find model confidentiality clauses and model contracts prepared and published by international organisations particularly useful.

AB  - Rad prikazuje jedan od novijih instituta savremenog arbitražnog prava - finansiranje troškova arbitraže od lica koje nisu stranke u postupku. Objašnjava se svrha i značaj ovog instituta, ukazuje na njegov trenutno važeći pravni režim i razmatraju određena otvorena pitanja koja se javljaju u vezi sa eksternim finansiranjem arbitraže. Zaključuje se da, iako u ovom trenutku veoma korisni, izvori mekog normativiteta kojima je ovaj institut u pretežnoj meri trenutno uređen nisu dovoljni da u punoj meri zaštite pravnu sigurnost svih učesnika u poslu eksternog finansiranja, kao i u arbitražnom postupku koji je eksterno finansiran, te da se u budućnosti može očekivati dalji razvoj specijalizovanih pravila o finansiranju troškova arbitraže od trećih lica.
AB  - The paper addresses third-party funding as one of the recent developments in international arbitration. The author tends to explain the purpose and the importance of third-party funding, presents the rules applicable to this institute and discusses some of the theoretic and practical problems linked to the external funding of international arbitration. It appears that the most significant pieces of legislation in this matter belong to soft law, which is seen as unsatisfactory on the long run, because soft law appears to be insufficient to guarantee the full protection of rights of all the participants in third-party funding, as well as in arbitration proceedings funded by a third party. Therefore, further development of legal framework for third-party funding in international arbitration is to be expected and desired.

AB  - The issue of necessity as a ground for precluding wrongfulness has received close attention over the last two decades both in case law and in scholarly writings. Arbitrations conducted against Argentina for breaches of bilateral investment treaty obligations committed while fighting against economic crisis revived the old controversies related to the concept of necessity in general public international law, but also brought up some new dilemmas. This paper analyses the use of necessity in international investment law in light of what the authors suggest to be the legal purpose of this concept, points to and discusses the divergences in case law with respect to some of the elements of the defence based on necessity and offers the solutions susceptible to lead to a more harmonious understanding of necessity in international investment law.

This paper analyses the use of necessity in international investment law in light of what the authors suggest to be the legal purpose of this concept, points to and discusses the divergences in case law with respect to some of the elements of the defence based on necessity and offers the solutions susceptible to lead to a more harmonious understanding of necessity in international investment law.",

AB  - U domaćoj pravnoj teoriji više puta je istaknuta neadekvatnost prevoda termina 'mesto poslovanja' iz originalnog teksta Konvencije UN o ugovorima o međunarodnoj prodaji robe u srpskom (jugoslovenskom) zakonu o ratifikaciji te Konvencije. Autor u ovom radu ispituje pravnu relevantnost navedene terminološke razlike. U tom cilju najpre se objašnjavaju koncepti sedišta i mesta poslovanja a zatim ispituju mogućnosti njihovog približavanja kroz eventualno tumačenje pojma mesta poslovanja u svetlu kriterijuma koji se koriste za utvrđivanje mesta sedišta. Pošto zaključuje da takvo približavanje nije moguće, autor dalje razmatra odnos Konvencije i zakona o njenoj ratifikaciji kako bi utvrdio kom terminu treba dati prednost i zaključuje da bi, nezavisno od termina upotrebljenog u zakonu o ratifikaciji, pojam mesta poslovanja trebalo tumačiti nezavisno od bilo kakvih nacionalnih koncepata, u skladu sa međunarodnim karakterom Konvencije i u svetlu međunarodne prakse u njenoj primeni, kako bi se ispunio uslov jednoobraznosti primene koji sama Konvencija postavlja.
AB  - It has been often pointed out in Serbian scholarly writings that the term 'place of business' used in the UN Convention on Contracts for the International Sale of Goods (CISG) was inadequately translated in the Serbian (Yugoslav) law on ratification of the Convention. This paper focuses on legal relevance of such mistranslation. To that effect, the author first explains the notions of seat and place of business and then moves on to consider the possibilities of overcoming the textual differences through interpreting the notion of place of business in light of the criteria used for determining the seat of a company. Since the analysis shows that such attempt would be futile, the author then studies the relation between the CISG and the law on its ratification in order to establish which term, seat or place of business, should be given precedence in application. This leads to the conclusion that, irrespective of the term used in the law on ratification, the notion of place of business should be read as such and interpreted autonomously from any national concepts. Such approach would be in line with the international character of the CISG. The guidelines for interpretation should be sought in international practice, which would, in turn, further promote the uniform application of the CISG.

AB  - U radu se razmatra problematika primene Konvencije UN o ugovorima o međunarodnoj prodaji robe na osnovu njenog člana 1(1)(b). U tom smislu, autor analizira pravnu prirodu ove odredbe, prikazuje uslove za njenu primenu i objašnjava relevantnost različitih pravila međunarodnog privatnog prava za primenu Konvencije. Naročita pažnja je posvećena domašaju rezerve na primenu konvencije sadržanoj u članu 95. Autor iznosi argumente protiv široko prihvaćenog shvatanja člana 1(1)(b) kao kolizione norme, ukazuje da je član 1(1)(b) podoban za primenu i u sudskom i u arbitražnom postupku rešavanja sporova iz ugovora o međunarodnoj prodaji robe i objašnjava značaj pravila o kvalifikaciji i uzvraćanju i preupućivanju za primenu Konvencije. U pogledu dejstva rezerve iz člana 95, autor smatra da je od presudnog značaja za primenu Konvencije stav prema rezervi države čije pravo merodavno, a ne države foruma.
AB  - The paper examines the problems with respect to the application of the UN Sales Convention (CISG) by virtue of its Article 1(1)(b). To that effect, the author analyzes the legal nature of this provision, describes the prerequisites for its application and explains the relevance of different rules of private international law for the application of the CISG. A special attention is given to the effects of Article 95 reservation. The author presents arguments against a widely spread opinion that the Article 1(1)(b) is in itself a conflict-of-laws rule, suggests that this provision is suitable to be applied both by courts and arbitral tribunals and explains the importance of the rules on classification and renvoi for the application of the CISG. With respect to the effect of Article 95 reservation, the author gives precedence to the position of the applicable law, rather than the law of the forum, concerning this reservation.

AB  - In the situation where the cross-border service of documents needs to be carried out by diplomatic means of communication between States, this procedure appears to be rather lengthy and slow. In this paper the author analyzes the rules on cross-border service of documents by diplomatic means as contained in the Serbian Code of Civil Procedure. As the main reasons of their inadequacy from the standpoint of procedural efficiency, the author sees the complexity of the procedure and the absence of any timeframe for its performance. In the light of these shortcomings, the author proposes modifications to be made to the procedure which is currently in force. These modifications include the reduction of the number of instances that a document needs to go through before being serviced, the reconfiguration of the duties of the institutions which take part in the service of documents et the introduction of time limitations for the performance of each specific step of the cross-border service of documents. Nevertheless, the author concludes that these modifications still have a limited scope due to the fact that the cross-border service of documents by diplomatic means is necessarily governed by two different laws and requires cooperation between the organs of different States. Therefore, the full improvement of the efficiency of cross-border service of documents can be reached either through global harmonization of rules in this sphere, or through introduction of technologically more advanced means of service of documents, such as service by electronic mail.

AB  - U ovom radu autor analizira stabilizacionu klauzulu sadržanu u Zakonu o javno-privatnom partnerstvu i koncesijama, posmatrajući je u kontekstu uporednopravnih iskustava sa tim instrumentom zaštite ulagačkih prava. Posebna pažnja je posvećena sistemskoj analizi mehanizama zaštite stranihulagača u srpskom pravu i interakciji između stabilizacionih klauzula u Zakonu o stranim ulaganjima i Zakonu o javno-privatnom partnerstvu i koncesijama. Autor zaključuje da je stabilizaciona klauzula iz Zakona o javno-privatnom partnerstvu i koncesijama po svom sadržaju najbliža klauzulama ekonomske ravnoteže i ukazuje na potencijalne probleme do kojih bi moglo da dođe u njenoj primeni.
AB  - In the present paper the author analyzes the stabilization clause contained in the Law on Public-Private Partnership and Concessions. This clause is exam­ined in the light of comparative experiences related to that instrument of protec­tion of investors' rights. A special attention is given to the holistic analysis of the protection mechanisms of investors' rights in Serbian law and the interaction between stabilization clauses contained in the Law on Foreign Investments and the Law on Public-Private Partnership and Concessions. The author concludes that the stabilization clause contained in the Law on Public-Private Partnership and Concessions is the most akin to the economic equilibrium clauses and puts forward potential problems that might arise with respect to the application of the said provision.

Osvrt na pravilnik o postupku za rešavanje sporova povodom registracije .rs domena

AB  - Krajem 2010. godine pristupilo se sveobuhvatnoj reformi alternativnog sistema rešavanja sporova povodom registracije .rs domena. Osnovana je Komisija za rešavanje sporova kao specijalizovano stalno telo pri Privrednoj komori Srbije i donet je novi Pravilnik o postupku za rešavanje sporova povodom registracije .rs domena. U pogledu materijalnopravnih odredaba, novi Pravilnik uglavnom prati rešenja UDRP pravila, čime se omogućava oslanjanje na međunarodnu praksu u ovoj oblasti. Praksa tela koja primenjuju UDRP pravila, kao i dosadašnja praksa arbitražnih veća pod okriljem Registra nacionalnog Internet domena Srbije biće zato od velike koristi u budućem tumačenju ovih uslova. U pogledu procesnopravnih odredaba, novi Pravilnik, koji je Skupština Registra nacionalnog Internet domena Srbije usvojila u decembru 2010. godine, znatno detaljnije uređuje pravila postupka. Naročito je afirmisano načelo ekonomičnosti propisivanjem relativno kratkih rokova za pojedine procesne radnje kao i za okončanje samog postupka, a razrešen je i sporan odnos alternativog i sudskog postupka za rešavanje sporova u ovoj oblasti.
AB  - In late 2010, the alternative dispute resolution system first put in place in 2007 for disputes related to .rs domain name registration has undergone significant reform. The Commission for Dispute Resolution has been founded as a specialized, permanent body within the Serbian Chamber of Commerce, and the new Rules on .rs domain name dispute resolution have been adopted. Regarding the substantive provisions, the new Rules are generally in line with the UDRP Rules, which allows for the reception of international practice in this field. The case-law of panels applying the UDRP Rules, as well as previous decisions adopted by panels acting under the auspices of the Serbian National Registar of Domain Names could serve as an inspiration for further interpretation of substantive rules. Furthermore, the new Rules have set up a more elaborated procedural framework than the one existing under the previous version of the Rules. The principle of procedural efficiency has been particularly enhanced through fixing relatively short time periods for performing certain procedural acts, as well as for conducting and completing the process itself. In addition, a somewhat problematic relationship between the court proceedings and the ADR mechanism in the previous version of the Rules has now been regulated in conformity with the relevant constitutional and statutory provisions.

AB  - Pitanje obaveze prodavca da isporuči robu saobraznu sa prinudnim propisima države odredišta nije izričito regulisano Konvencijom Ujedinjenih nacija o ugovorima o međunarodnoj prodaji robe. Ipak, na osnovu opštih kriterijumima za procenu saobraznosti robe i pravi la tumačenja Konvencije moguće je identifikovati situacije i okolnosti pod kojima će obaveza poštovanja prinudnih propisa države odredišta biti uspostavljena. U radu se ispituju uslovi za valjanost eksplicitnog utvrđivanja ove obaveze, analiziraju slučajevi kada će se obaveza smatrati implicitno prihvaćenom i razmatraju situacije kada usklađenost robe sa prinudnim propisima države odredišta čini deo njene posebne svrhe. Na kraju, autor pokušava da oceni koji bi način predviđanja obaveze isporuke robe saobrazne sa prinudnim propisima države odredišta bio najprihvatljiviji za obe strane u ugovornom odnosu.
AB  - The issue of seller's obligation to deliver goods conforming to the public law requirements of the place of destination is not explicitly settled by the Convention on contracts for international sale of goods. However, general criteria for assessing conformity of the goods seen in light of the interpretative rules may help identifying specific situations in which the obligation to comply with public law requirements is considered to be established between the parties. This paper examines the ways in which this obligation can be explicitly introduced into a contract, as well as the situations in which this obligation is deemed to be implicitly stipulated. The author also analyzes whether the compliance with public law requirements may be considered to make a part of specific purpose of the goods. Finally, the author tries to asses the most acceptable and the most efficient way of establishing seller's obligation to deliver goods conforming to the public law requirements of the place of destination.
