AB  - Ne postoji mnogo tema u međunarodnom pravu koje su kompleksnije, heterogenije, sa više regionalnih i kontekstualnih specifičnosti, ali i više ispolitizovane, od pitanja sukcesije država, pa samim tim i sukcesije odgovornosti. Ako pogledamo samo XXI vek, lako se može uočiti veliki broj (novo)otvorenih političkih pitanja i teritorijalnih nesuglasica između država. Upravo zbog navedenog značaja, ali i aktuelnosti ove teme, autori su u navedenom članku analizirali rad Komisije za međunarodno pravo po pitanju sukcesije odgovornosti država. U radu su konsekutivno analizirani najzanimljiviji delovi četiri izveštaja Pavela Šturme, izvestioca Komisije za međunarodno pravo, uz adekvatan normativni i komparativni osvrt sa ciljem njihove kontekstualizacije i ocene. Fokus rada je na načinu na koji je Komisija pristupila ovom pitanju, koje je jedno od najkomplikovanijih u međunarodnom pravu. Još jednom se pokazao kao dobitan pristup u kome se daju smernice i okviri ali se ostavlja dovoljno prostora državama da svoje međusobne odnose regulišu na način koji smatraju najprikladnijim.
AB  - There are not many topics in international law which are more complex, more heterogeneous, with more regional and contextual particularities, but also more politicized than the issue of succession of states and therefore the succession of responsibilities. In the 21st century alone, there are numerous open issues, among which the issue of Kosovo* is of particular importance for the Republic of Serbia. The mentioned significance of this topic, alongside its actuality and legal complexity is the reason why the authors decided to analyze the work of the International Law Commission on the issue of the succession of state responsibilities in the above article. The reports of Pavel Šturma, the rapporteur of the International Law Commission, were analyzed consecutively, highlighting the most significant features, with an adequate normative and comparative review. Through the analysis of all four reports provided by the rapporteur, the authors did not focus only on the tasks given to the rapporteur and his findings. Instead, they are also emphasizing dilemmas, other views, and opinions that were brought by various countries but also provide a historical and comparative context of both issues and solutions. While this topic could be further analyzed in many more articles and books, a clear overview of the work of the International Law Commission and Mr. Šturma on the topic of the succession of responsibilities in international law was provided. This approach benefits both younger scholars and practitioners looking for a firm basic article to commence research as well as for more experienced researchers and their need for more in-depth analysis. Legal analysis, focused on normative framework, resulted from the work of the Commission, as well as on practical implications is the basis of the authors' approach in this article.

Održivost koncepta regionalnih kogentnih normi - opšti sistem protiv evropskog sistema

AB  - U ovom radu predstavljena je analiza jednog novog i osetljivog pitanja od interesa za čitavu međunarodnu zajednicu - pitanje regionalnih kogentnih normi. Polazi se od aktuelnog rada Komisije za međunarodno pravo Ujedinjenih nacija i prate diskusije i komentari kako država tako i vodećih autora po ovom pitanju. Autor zauzima jasan stav da bi trebalo prihvatiti regionalne kogentne norme, s obzirom na to da one već kao takve postoje na području Evrope i to u sistemu Saveta Evrope i Evropskog suda za ljudska prava, ali i u sistemu Evropske unije. Ukazano je da regionalne kogentne norme postepeno bivaju prihvaćene i na drugim područjima, recimo na tlu Amerike, pa je to samo jedan od razloga za njihovo priznanje. Nažalost, članovi Komisije za međunarodno pravo još uvek nisu zauzeli stav o priznanju ovih normi, iako postoje značajni autori koji podržavaju njihovo prihvatanje. U radu je jasno pokazano da iako se često pitanje regionalnih kogentnih normi dovodi u vezu sa fragmentacijom međunarodnog prava, ovo predstavlja pozitivan aspekt. Naime, prihvatanje regionalnih kogentnih normi predstavljalo bi unapređenje čitavog međunarodnog prava, ali nikako po cenu postojanja opštih kogentnih normi. Autor insistira na tome da je područje Evrope bilo tlo gde se rodilo međunarodno pravo i gde je stepen integracije država na najvišem nivou, pa bi se preko regionalnih kogentnih normi unapredilo čitavo međunarodno pravo, kao i ljudska prava uopšte.
AB  - This paper presents an analysis of a new and sensitive issue of interest to the entire international community - the issue of regional ius cogens norms. It starts from the current work of the United Nations Commission on International Law and follows discussions and comments from both states and leading authors on this issue. The author takes a clear position that regional ius cogens norms should be accepted, considering that they already exist as such in Europe within the system of the Council of Europe and the European Court of Human Rights, but also in the system of the European Union. It was pointed out that regional cogent norms are gradually being accepted in other areas, for example, on American soil, so that is only one of the reasons for their recognition. Unfortunately, members of the International Law Commission have still taken a stand on the recognition of these norms, although some significant authors support their acceptance. The paper clearly shows that although the issue of regional ius cogens norms is often associated with the fragmentation of international law, this is a positive aspect. Namely, the acceptance of regional ius cogens norms would represent the improvement of the entire international law, but not at the cost of the existence of general ius cogens norms. The author insists that the area of Europe was the ground where international law was born and where the degree of integration of states is atthe highestlevel, so the entire international law, aswell as human rights in general, would be improved through regional coherent norms.

AB  - Model genocidnog uništenja podrazumeva način na koji se genocid vrši. Izvedena iz tog osnovnog su i pitanja da li su masovna ubistva, kulturne represije, izgladnjivanje, prevencija rađanja ili politocid sve načini izvršenja genocida ili se genocid u tom pogledu limitira na biološko odnosno fizičko uništenje zaštićene grupe. Posleratni razvoj međunarodnog prava, pre svega deklaracije i Paktovi UN-a, te brojne konvencije vezane za ljudska prava kao i sudska praksa dva tribunala, signalizirali su postojanje šireg običajnopravnog koncepta genocida koji bi u sebi mogao involvirati i prerogative kulturnog uništenja. U modernim teorijskim shvatanjima ispoljena je slična tendencija. S aspekta de lege ferenda, to se može razumeti i tumačiti kao pozitivna tendencija, ali je istovremeno diskutabilno sa stanovišta legislativnog i konzervativnog karaktera Konvencije. U radu se elaboriraju materijalni akti genocida i pozicioniranje istih unutar idejnog koncepta zločina genocida u svetlu kontroverzi modela genocidnog uništenja.
AB  - A model of genocidal destruction implies the manner in which genocide is carried out. Questions deriving from my fundamental point at issue are whether mass killings, cultural repressions, starvation, prevention of birth, politicide constitute genocide or whether genocide, in that sense, is limited to biological or physical destruction of a protected group? the post-war development of international law, especially as a result of the adoption of the Universal Declaration of Human Rights and Convention on Human Rights, and a number of conventions related to human rights, as well as jurisprudence of the two tribunals, signaled the existence of a wider concept of a customary-legal concept of genocide, that could intrinsically involve a prerogative of cultural destruction. The modern theoretical views have expressed such a tendency. From a "de lege ferenda" perspective, this could be interpreted and understood as a positive tendency, but at the same time it is questionable from the perspective of a legislative and formal-legal character of the Convention on the Prevention and Punishment of the Crime of Genocide. This paper elaborates material acts of genocide and their position within the concept of genocide considering the controversies of the models of genocidal destruction.

Mesto i uloga vojnih atašea u pozitivnom diplomatskom pravu

AB  - Institut vojnih atašea je veoma intrigantan i bezbednosno važan za svaku državu. U radu je predstavljen razvoj vojnih atašea, kao i razlozi njihovog uvođenja u vršenje diplomatske službe i prikupljanje informacija od interesa za svaku državu. Naročita pažnja posvećena je evoluciji vojnih atašea u sistemu Republike Srbije. U nastavku su predstavljene osnovne funkcije koje obavljaju vojni atašei, kao i odnos sa diplomatskim osobljem u misiji. Analizirana je posebna pravna priroda subordinacije koja postoji u vezi s vojnim atašeima, koja je podeljena između šefa diplomatske misije (ministarstva spoljnih poslova) i ministarstva odbrane i generalštaba. U radu se naročito ističu bezbednosni aspekt angažovanja vojnih atašea i delikatnost posla koji oni obavljaju. U tom smislu prikazane su osnovne privilegije i imuniteti koje poseduju vojni atašei, a koji su analogni diplomatskim imunitetima. Na kraju rada ukazuje se i na povremene nepravilnosti u njihovom radu koje mogu da se kreću od zloupotrebe imuniteta pa sve do špijunaže kao teškog krivičnog dela. Zaključeno je da vojni atašei čine važnu kariku u diplomatskim odnosima država i da je taj institut specifičan i veoma koristan za pozitivnu saradnju država i unapređenje prijateljskih odnosa.
AB  - The institute of military attaches is very intriguing and important for security of every country. The paper presents the development of military attachés, as well as the reasons for their introduction into the exercise of diplomatic service and the collection of information of interest to each state. Special attention was devoted to the evolution of military attachments in the system of the Republic of Serbia. Below are the basic functions performed by military attachés, as well as the relationship with the diplomatic staff in the mission. The special legal nature of the subordination of the military attachés was analyzed, which was divided between the head of the diplomatic mission - the foreign ministry, and, on the other side, the ministry of defense. The paper highlights the security aspect of engaging military attachés and the delicacy of the work they perform. In this sense, the basic privileges and immunities of military attachés, which are analogous to diplomatic immunities, are shown. At the end of the paper, there are also indications of occasional irregularities in their work that can range from the abuse of immunity, to espionage as a serious criminal offense. It was concluded that military attachés constitute an important link in the diplomatic relations of the states, but that this institute is specific and very useful for the positive cooperation of states and the improvement of friendly relations.

Analizirana je posebna pravna priroda subordinacije koja postoji u vezi s vojnim atašeima, koja je podeljena između šefa diplomatske misije (ministarstva spoljnih poslova) i ministarstva odbrane i generalštaba. U radu se naročito ističu bezbednosni aspekt angažovanja vojnih atašea i delikatnost posla koji oni obavljaju. U tom smislu prikazane su osnovne privilegije i imuniteti koje poseduju vojni atašei, a koji su analogni diplomatskim imunitetima. Na kraju rada ukazuje se i na povremene nepravilnosti u njihovom radu koje mogu da se kreću od zloupotrebe imuniteta pa sve do špijunaže kao teškog krivičnog dela. Zaključeno je da vojni atašei čine važnu kariku u diplomatskim odnosima država i da je taj institut specifičan i veoma koristan za pozitivnu saradnju država i unapređenje prijateljskih odnosa., The institute of military attaches is very intriguing and important for security of every country. The paper presents the development of military attachés, as well as the reasons for their introduction into the exercise of diplomatic service and the collection of information of interest to each state. Special attention was devoted to the evolution of military attachments in the system of the Republic of Serbia. Below are the basic functions performed by military attachés, as well as the relationship with the diplomatic staff in the mission. The special legal nature of the subordination of the military attachés was analyzed, which was divided between the head of the diplomatic mission - the foreign ministry, and, on the other side, the ministry of defense. The paper highlights the security aspect of engaging military attachés and the delicacy of the work they perform. In this sense, the basic privileges and immunities of military attachés, which are analogous to diplomatic immunities, are shown. At the end of the paper, there are also indications of occasional irregularities in their work that can range from the abuse of immunity, to espionage as a serious criminal offense. It was concluded that military attachés constitute an important link in the diplomatic relations of the states, but that this institute is specific and very useful for the positive cooperation of states and the improvement of friendly relations.",

Takođe rad naglaševa potrebu za preciznijim kriterijumima pri određivanju normi ius cogens kao i za radom na kompilaciji pravila o peremptornim normama u pozitivnom međunarodnom pravu. Predstavljena je vrlo heterogena praksa međunarodnih tela prilikom determinisanja i identifikovanja peremptornih normi, ukazujući tako na važnost preciznog određenja kriterijuma za određivanje ovih pravila kao i smernica u kojima bi išao dalji razvoj ovih pravila. Detaljno je analiziran i odnos između prava Ujedinjenih nacija i ius cogens i date su određene preporuke za međusoban odnos. Na kraju, podvučena je i važnost ius cogens pravila u sprečavanju potencijalne fragmentacije međunarodnog prava.
AB  - The paper presents the development of peremptory norms (ius cogens) in international law and their constitution through the Convention on the Law of Treaties. It first analyses the work of the International Law Commission, which preceded the introduction of peremptory rules into international law; the Commission subsequently moved onto the consideration of peremptory norms, which remains in its focus at the present. Special attention is given to, on one hand, the doctrine on peremptory rules and, on the other hand, to the international case law in this matter. The need for more precise criteria for the determination of ius cogens, as well as the compilation of a framework list of peremptive norms in positive international law, is stressed. Heterogeneous practices of international bodies in identifying peremptory rules are presented, demonstrating the need to precisely define the criteria for determining such rules and to guide the further development of imperative rules. The relationship between ius cogens and the United Nations law is analysed and certain guidelines are provided for the mutual relationships of ius cogens rules. The importance of ius cogens rules in preventing potential international law fragmentation is particularly emphasized.

AB  - One of the priority values of the modern legal systems is the concept of environmental protection. The European Union has introduced the concept of environmental protection, i.e. liability and compensation for damage caused by wrongful acts directed against environmental values, as one of the fundamental principles firmly embedded in their legal system. Directive 2004/35/EC and Directive 2008/99/EC establish the legal framework for environmental liability systems of EU Member States. The first Directive 2004/35/EC does not deal with civil liability with regard to the prevention of environmental damage. Directive 2008/99/EC on the protection of the environment through criminal law lays down the principles to be followed by Member States in the field of environmental criminal law. Environmental crimes are becoming increasingly recognised as a serious threat to the 'rule of law' systems as one of the common values upon which the union is founded. The Directive 2008/99/EC should be seen as an important instrument of fight against environmental crime. It may be concluded that it is of crucial importance for EU Members States and Candidate Countries to implement the standards set out in the EU Environmental Directives.

AB  - The paper analyzes Serbian system of local selfgovernment under the Constitution of 2006 and its possible improvements. There are two major aspects of reform. On the one side, there are weaknesses in internal law and practice that were detected in last three decades and six concrete proposals for their correction. On the other side, considering that Serbia negotiates on integration with the EU, some improvements of the system should be a result of that process, fully in accordance with the European standards of local self-government. Reforming the local selfgovernment in both of these directions should lead to better legal framework in the Republic of Serbia and upgrading the constitutional system.

AB  - Autor se bavi razvojem pravila o krivičnopravnom imunitetu najviših predstavnika države na međunarodnom planu. Posebna pažnja usmerena je na praksu Međunarodnog suda pravde, ali i rad Komisije za međunarodno pravo koja ovo pitanje obrađuje nekoliko godina. Jedan od važnih pokazatelja jeste i praksa država koja pokazuje da postoji jasan konsenzus o potrebi da najviši predstavnici države budu izuzeti od nadležnosti drugih država. Podvlači se običajni karakter takvih pravila, a nova praksa Međunarodnog suda pravde, kao i nacionalnih sudija, ukazuju da je povećan broj sporova država u vezi primene imuniteta na unutrašnjem planu. Detaljno su analizirani i izuzeci od primene ovog pravila, a pogotovo u slučaju međunarodnih zločina kada je opravdano pozivanje na odgovornost. Autor je, analizirajući ovaj institut, došao do zaključka da se radi o procesnoj pravnoj prirodi, ali i da je neophodno uvesti precizne kriterijume u pogledu ratione persone domašaja krivičnopravnog imuniteta.
AB  - The author deals with the development of rules of criminal immunity of the highest representatives of the state at the international level. The criminal immunity of state representatives has emerged from the rules on equality of States and is associated with the maxim par in parem non habet imperium. Special attention is given to the practice of the International Court of Justice, and the work of the International Law Commission, which deals with this issue for several years. The author has presented the resolution of the Institute of International Law, which deals with the immunity of the official representatives of the state. As one of the important indicators is the practice of States which shows that there is a clear consensus on the need for the highest state representatives are exempt from the jurisdiction of other States. The paper discusses the similarities and differences in terms of criminal immunity of diplomatic representatives and high state representatives. Underlines the customary character of such rules, a new practice of the International Court of Justice, as well as national judges, indicating that the increased number of disputes concerning the application of state immunity internally. The pointed on exemptions from the application of this rule, especially in the case of international crimes where justified calling to account. The author has analyzed the institute came to the conclusion that it is procedural legal nature, but that it was necessary to introduce precise criteria in terms of ratione personae of the reach of criminal immunity. The author has attempted to establish clear criteria in terms of differentiating the state representatives who have full criminal immunity of senior officials who have only functional immunity. The author concluded that the issue of the immunity of a State official from foreign criminal jurisdiction should, in principle, be considered at an early stage of the judicial proceedings, or earlier still, at the pretrial stage, when a State exercising jurisdiction takes a decision on adopting criminal procedure measures precluded by immunity against an official. The author also concluded that it is generally accepted that the authority to waive a State official's immunity lies with the State and not with the state official. With respect to the withdrawal of immunity of state representatives there is a complete correspondence with the withdrawal of immunity of diplomatic representatives. A general conclusion about the waiver of immunity of State officials from foreign criminal jurisdiction could be phrased approximately as follows: when applied to a serving Head of State, Head of Government or minister for foreign affairs, a waiver of immunity should be explicitly stated. The author concludes that the issue of criminal immunity of state representatives does not affect the question of state responsibility. State responsibility is established at the international level, and immunity operates in internal order.

Međunarodni sud pravde je u nekoliko navrata naglasio potrebu formiranja posebnih pravila u ovoj oblasti, a rad na prikupljanju pravila započela je Komisija za međunarodno pravo. Specifičnost ovog pitanja je u tome što je reč o kombinaciji normi međunarodnog humanitarnog prava, prava životne sredine, a delimično i ljudskih prava. Pored toga, u modernoj međunarodnoj zajednici došlo je do velikog razvoja sredstava za ratovanje, pa je utoliko potreba regulisanja pitanja zaštite životne sredine u oružanim sukobima od primarnog interesa. U radu je analizirana pozitivno pravna regulativa iz ove oblasti, praksa sudova i arbitraža, kao i rad Komisije za međunarodno pravo. Izloženo je trenutno stanje normi i predstavljen je de lege ferenda pravac razvoja pravila.
AB  - The paper analyzes the highly topical issue of environmental protection in armed conflicts which constitutes the general interest of the security of the entire international community. The International Court of Justice has on several occasions stressed the need of forming special rules in this area, and the collection of rules has been initiated by the International Law Commission. The specificity of this issue is that it is a combination of the norms of international humanitarian law, environmental law, and, in part, the issues of human rights. In addition to this, the modern international community has seen a great development of means of warfare which implies that the need to regulate the issue of environmental protection in armed conflict is of primary interest. The paper analyzes the legal regulations in this field, the practice of courts and arbitration, as well as the work of the International Law Commission. The survey features current national standards and newly introduced development policies. The conclusion is that the current state standards that are directly related to the protection of the environment are unsatisfactory and that it is necessary to do much more to improve environmental protection in armed conflicts. It is particularly harmful that a number of very influential countries have repeatedly insisted on restricting the scope of some of the essential provisions of the Conventions relating to the protection of the environment in armed conflict. The reason was that they wanted to ensure that nuclear weapons can be applied in exceptional circumstances. Such an attitude of the leading countries within the international community undermines the establishment of legal provisions on environmental protection in armed conflicts.

Ukazuje se na tradicionalnu zasnovanost imuniteta na suverenosti, da bi se usled sve veće komunikacije država došlo do prihvatanja funkcionalne koncepcije. Rad dalje prati i analizira delatnost Komisije za međunarodno pravo koja je okončana usvajanjem Konvencije o jurisdikcionom imunitetu država i njihove imovine 2004. godine. U daljem tekstu tumače se odredbe Konvencije i ukazuje na mogući domašaj pravila, ističu izuzeci i daje nagoveštaj o mogućem stupanju na snagu. U radu se zaključuje da se na ovaj način uvodi pravni poredak povodom jednog veoma delikatnog pitanja čime se stvara koncept normi relativnog domašaja.
AB  - The paper deals with the analysis of state immunity in international law, its development in terms of theoretical approaches, codification procedure, but very broad and diverse state practice. Refers to the traditional foundation of the sovereign immunity, due to growing communication states occurred acceptance of functional concepts. Work continues to monitor and analyze the activity of the International Law Commission, which was completed in adoption of the Convention on the Jurisdictional Immunities of States and Their Property 2004th year. Below interpret the provisions of the Convention and points to the possible scope of the rules, exceptions stand out and gives a hint about the possible entry into force. The paper concludes that this method introduces a legal order on the occasion of a very delicate issue which creates the concept of norms relative reach.

AB  - The paper analyzes an issue of fundamental significance for international law - the procedure for the identification of custom in public international law. Since customary law may be qualified as a sui generis source of international law, instruments and procedures for proving customs are of major importance. Particular attention is given to the role of custom in modern international law. The first part of the paper outlines the work of the International Law Commission relating to formation and evidence of customary law, including its identification. The second part of the article analyzes the jurisprudence of the International Court of Justice concerning the process of formation of customary law, instruments through which it is evidenced, as well as the procedures for evidencing it. Particularly noteworthy is the necessity to introduce objectified rules for detecting customs and to determine the scope of these rules, both internationally - for a number of actors, as well as internally - in the legal systems of States.

Obrađuje relevantnu praksu država, kao i sudsku praksu, posebno, Međunarodnog suda pravde. Predstavljen razvoj običajnih pravnih pravila vezanih za diplomatsku zaštitu i njihovo formulisanje u jednu sistemsku pravnu celinu preko rada Komisije za međunarodno pravo. U tom smislu navedene su osnovne etape u kodifikaciji pravila u vezi sa diplomatskom zaštitom i doprinosom Ujedinjenih nacija na polju zaštite prava stranih državljana. Prikazan je novi razvoj univerzalnih i regionalnih mehanizama zaštite prava čoveka i istaknut uticaj koji se na taj način vrši na primenu tradicionalnih mehanizama diplomatske zaštite.
AB  - The paper deals with the issue of the diplomatic protection in international law and its development through the history of the international community. In this sense, the author investigates the practice of states regarding the application of diplomatic protection and the steps taken by the International Law Commission of the United Nations on the codification of this area. In 2004 International Law Commission adopted at first reading a full set of draft articles. In this paper is presented judicial practice, especially of the International Court of Justice, in the field of diplomatic protection in order to evaluate whether the approach of the Court to diplomatic protection has become more human-rights oriented in the last few years. Author presents the development of customary law rules relating to diplomatic protection and its transition into a whole system of rules through the work of the International Law Commission. In this sense, these are the basic stages in the codification of rules on diplomatic protection and the United Nations contribution to the protection of the rights of foreign nationals. This article points the development of universal and regional mechanisms to protect human rights and highlights the impact of those mechanisms on traditional measures of diplomatic protection.

Pre nego što se postavi pitanje odgovornosti države na međunarodnom planu, za povredu prava stranog državljanina ili preduzeća neophodno je pokušati postići pravnu zaštitu pred unutrašnjim organima države. Autor na početku obrađuje specifičnu evoluciju diplomatske zaštite, od mere međudržavne intervencije, do jedne od pravno dopuštenih aktivnosti koju država može da primeni radi zaštite prava sopstvenog državljanina. Istražuje se formiranje ovog pravila na univerzalnom nivou, kao i arbitražna praksa, s posebnim osvrtom na praksu Međunarodnog suda pravde u ovoj oblasti. Takođe se analizira rad Komisije za međunarodno pravo Ujedinjenih nacija u pogledu Nacrta o diplomatskoj zaštiti i navedeni su neki osnovni izuzetci od primene pravila o obavezi iscrpljenja unutrašnjih pravnih sredstava zaštite. Posebno se skreće pažnja na pogrešne zaključke autora, pogotovo onih koji se bave ljudskim pravima, o formiranju pravila o direktnoj nadležnosti međunarodnih tela. Istina je da se države u praksi ponekad odriču mogućnosti vođenja postupaka na nacionalnom nivou, ali tako nastaju samo obaveze inter partes, a nikako one koje su erga omnes prirode, kakvo je nesumnjivo pravilo o obaveznom korišćenju unutrašnjih sredstava zaštite.
AB  - The author analyses the so-called ‘rule of exhaustion of local remedies’ as a necessary condition of diplomatic protection. State must be given the opportunity to redress the alleged wrongdoing within the framework of its own domestic legal system, before its international responsibility may be examined at the level of international community. The paper starts off with an overview of the historical development of diplomatic protection in international law, and then focuses on the question of legal development of the ‘rule of exhaustion of local remedies’, the existing practices before the arbitral courts and the International Court of Justice, and the issue of whether or not the approach of the Court to diplomatic protection has become more human-rights oriented in the last few years. The author offers different theoretical views of development of the rule on the universal level, and considers this rule as on of the necessary conditions of diplomatic protection in international law. The author emphasizes the work of International Law Commission of United Nations on Draft Article on Diplomatic Protection, and analyzes some of the exceptions from the rule of exhaustion of local remedies. Furthermore, he examines the development of universal and regional mechanisms to protect human rights and highlights the impact of those mechanisms on the traditional measures of diplomatic protection and the ‘rule of exhaustion of local remedies’. A state may waive, by means of an international agreement and in relation to another contracting party, the right to use the internal systems of legal protection. Still, such agreement does not apply universally, nor it implies the existence of an universal rule of the same content.

Furthermore, he examines the development of universal and regional mechanisms to protect human rights and highlights the impact of those mechanisms on the traditional measures of diplomatic protection and the ‘rule of exhaustion of local remedies’. A state may waive, by means of an international agreement and in relation to another contracting party, the right to use the internal systems of legal protection. Still, such agreement does not apply universally, nor it implies the existence of an universal rule of the same content.",

Pripisivost je, s druge strane, neophodni uslov za utvrđivanje odgovornosti, pa je jasno da se radi o nezaobilaznom pojmu od velikog značaja za međunarodno pravo. Osnovi pripisivosti su se tokom prakse širili i danas postoji veći broj nespornih osnova za pripisivost akata samoj državi. To se može videti iz arbitražne i sudske prakse, ali i iz rada Komisije za međunarodno pravo Ujedinjenih nacija. Rad razmatra tradicionalne osnove pripisivosti na osnovu navedenih izvora, ali i ukazuje na osnovne probleme koji se javljaju povodom primene nekih od novih osnova pripisivosti. Autor daje i kritički osvrt na proširenje već postojećih osnova pripisivosti akata samoj državi.
AB  - There may not be state liability for wrongful act if the act concerned is not attributable to the State. The issue of attributability is quite complex, as the individuals may have gone beyond the limits of authority bestowed upon them by the State, or their connection to the State may be restricted. The author examines the concept of attributability in international law, focusing on the traditional grounds of attributability, and critically inspecting justification for its newer grounds. In that regard, the author analyzes a number of cases before the International Court of Justice, and the work of the International Law Commission.

U tom smislu obrađuje se praksa država u pogledu primene diplomatske zaštite i koraci koji su preduzeti od strane Komisije za međunarodno pravo Ujedinjenih nacija na kodifikaciji ove oblasti. Predstavljeni su osnovni uslovi za pokretanje diplomatske zaštite i ukratko analizirana njihova sadržina - iscrpljenje unutrašnjnih pravnih sredstava države i utvrđivanje državljanstva. Na kraju je ukazano na neke osnovne smernice za razvoj diplomatske zaštite i njenu vezu sa ostalim grana prava koje imaju međunarodni element.
AB  - The author deals with diplomatic protection in international law and its development through history of the international community. In this sense, he studies the practice of States regarding the application of diplomatic protection and the steps being taken by the United nations international law Commission on the codification of this area. The author presents some basic conditions for launching diplomatic protection briefly analyzing their contents - the exhaustion of internal remedies and determination of citizenship. in the end, the article presents some basic guidelines for the development of diplomatic protection and its relationship with other branches of law which have an international element.

AB  - Ovaj rad se bavi istraživanjem pitanja rezervi u sistemu konvencija koje su zaključene u Savetu Evrope, a naročito pitanjem rezervi na Konvenciju o pravima čoveka. Na početku su analizirani pripremni radovi na usvajanju pravila koja se odnose na formulisanje rezervi na Konvenciju o pravima čoveka, ali i pravila iz drugih evropskih konvencija. Zatim je analizirana praksa Evropskog suda za ljudska prava prilikom procene dopustivosti rezerve sa predmetom i ciljem Konvencije preko određenih upečatljivih slučajeva, i uspostavljanje standarda 'evropski poredak'. Potom je iznet kritički osvrt na rad Evropskog suda na ljudska prava i analizirana je opravdanost odluka suda sa stanovišta na čela pravne sigurnosti, zabrane retroaktivnosti i s obzirom na druga čiji sistem pravnih pravila koji egzistira na univerzalnom nivou. Na kraju su izneta neka osnovna viđenja budućeg razvoja pravila i prakse u okviru Saveta Evrope, ali i opstanak druga čijeg paralelnog sistema normi na univerzalnom nivou.
AB  - The purpose of this article is to provide a systematic review of reservations in the Council of Europe Conventions and especially reservations to the Convention of Human Rights and Fundamental Freedoms. In the first part of this article the author analyzes preparatory work of states on articles about reservations to the Convention of Human Rights and other European Conventions. The second part focuses the case law of the European Court of Human Rights and application of the Convention in some major cases and legal standards of the European order. A comparative and critical review of case law in the European Court of Human rights is presented together with its decisions in the light of major legal norms in the national and international laws. Finally, the author investigates the influence of regional practice in the Council of Europe and survival of this system on the universal level in the international law. The author especially points out the importance of reservations to treaties in the modern international law, particularly in the ratification process of main universal normative treaties.

AB  - Ukoliko se posmatra celokupna diskusija vođena po pitanju komandne odgovornosti mogu se izvući neke osnovne poruke čiji je značaj nesumnjiv. Na osnovu iznetih razmatranja jasno je podvučeno da se radi o u najmanju ruku veoma spornom institutu povodom koga je prisutno vertikalno dejstvo međunarodnog prava na unutrašnje. To je samo još jedna od potvrda sve jačeg uticaja međunarodnog prava na unutrašnje, u segmentima koji su bili do skora suvereno polje država. Ipak, ne može se opovrgnuti značaj koji ima univerzalna kodifikacija u oblasti međunarodnog krivičnog prava, niti uvođenje instituta komandne odgovornosti, bar u onom njenom delu gde se radi o umišljajnom delovanju pretpostavljenog. Ono što ostaje kao sporno mesto koje nije prihvaćeno u praksi, jeste eventualna odgovornost pretpostavljenog za nehatno postupanje, ali i sama odgovornost civilnog pretpostavljenog. Ipak, pošto je reč o institutu koji još uvek nije primenjivan na univerzalnom planu neophodno je sačekati da Rimski statut počne da se primenjuje. Iako, na prvi pogled klauzula o komplementarnosti pruža donekle zaštitu suverenosti država, jer predviđa u načelu primarnu jurisdikciju domaćeg suda, ona praktično ne može dovesti do izigravanja potpune primene odredaba Rimskog statuta za one države koje su se na njega obavezale. Sa stanovišta našeg pravnog sistema, budući da smo prihvatili Rimski statut, već postoji međunarodnopravna obaveza na direktnu primenu svih odredaba statuta, koji je postao, u celini, deo našeg unutrašnjeg prava.

abstract = "Ukoliko se posmatra celokupna diskusija vođena po pitanju komandne odgovornosti mogu se izvući neke osnovne poruke čiji je značaj nesumnjiv. Na osnovu iznetih razmatranja jasno je podvučeno da se radi o u najmanju ruku veoma spornom institutu povodom koga je prisutno vertikalno dejstvo međunarodnog prava na unutrašnje. To je samo još jedna od potvrda sve jačeg uticaja međunarodnog prava na unutrašnje, u segmentima koji su bili do skora suvereno polje država. Ipak, ne može se opovrgnuti značaj koji ima univerzalna kodifikacija u oblasti međunarodnog krivičnog prava, niti uvođenje instituta komandne odgovornosti, bar u onom njenom delu gde se radi o umišljajnom delovanju pretpostavljenog. Ono što ostaje kao sporno mesto koje nije prihvaćeno u praksi, jeste eventualna odgovornost pretpostavljenog za nehatno postupanje, ali i sama odgovornost civilnog pretpostavljenog. Ipak, pošto je reč o institutu koji još uvek nije primenjivan na univerzalnom planu neophodno je sačekati da Rimski statut počne da se primenjuje. Iako, na prvi pogled klauzula o komplementarnosti pruža donekle zaštitu suverenosti država, jer predviđa u načelu primarnu jurisdikciju domaćeg suda, ona praktično ne može dovesti do izigravanja potpune primene odredaba Rimskog statuta za one države koje su se na njega obavezale. Sa stanovišta našeg pravnog sistema, budući da smo prihvatili Rimski statut, već postoji međunarodnopravna obaveza na direktnu primenu svih odredaba statuta, koji je postao, u celini, deo našeg unutrašnjeg prava.",
