AB  - Ovaj rad sadrži pravnu analizu prava naroda na imovinu. Na početku se analizira složena pravna priroda ovog prava, koje se po kriterijumu pretežnosti obično svrstava u grupu ekonomskih prava. Nakon toga se izlaže njegovo definisanje u međunarodnim instrumentima o ljudskim pravima - prvo u univerzalnim i regionalnim, a zatim i u Evropskoj konvenciji o ljudskim pravima. Nakon analize normi sledi razmatranje značajnijih odluka Evropskog suda za ljudska prava i zaključna razmatranja.
AB  - This paper contains a legal analysis of the right to property. Initially, the complex legal nature of this right is analyzed, which, by criterion of predominance, is usually classified in a group of economic rights. After that, definition of the right to property in international human rights instruments is presented - firstly in the universal and regional documents and then in the European Convention on Human Rights. Following the analysis of these norms, consideration of the important decisions of the European Court of Human Rights and concluding remarks are demonstrated.

AB  - U radu se analizira teritorijalno uređenje Kraljevine Srba, Hrvata i Slovenaca, odnosno Kraljevine Jugoslavije. Nakon kratkog osvrta na nastanak te države, koji je u velikoj meri uticao na njenu teritorijalnu organizaciju, razmatraju su sistemi teritorijalnog uređenja u oba njena ustava - Vidovdanskom i Septembarskom. Na kraju se iznosi ocena stepena samouprave koji su ti sistemi predviđali.
AB  - The paper analyzes territorial organization of the Kingdom of Serbs, Croats and Slovenes, i.e. the Kingdom of Yugoslavia. After a brief review of the emergence of that country, which largely influenced its territorial organization, the systems of territorial organization in both of its constitutions the "Vidovdan" Constitution and the "September" Constitution - were analyzed. Finally, there is a short evaluation of the degree of self-government that these systems envisioned.

Amendments to the Serbian Law on Local Self- Government 2018-Goals and Achievements

AB  - The paper analyzes the constitutional and legal foundations of local self-government in Serbia. The long-awaited reform of local self-government had two aspects: the correction of technical errors and alignment with the amendments to other laws, as well as the adoption of amendments related to the essence of local self-government. The second aspect mainly covered four issues: the competencies of local self-government, local self-government bodies, the position of the local community and the cooperation between units of local self-government. This reform, however, did not meet expectations, as it did not adequately solve any of the five key problems of local self-government in Serbia.

Judiciary in the Serbian Constitution of 2006 and a critical review of draft amendments

AB  - This article analyzes the position of judiciary in the Constitution of the Republic of Serbia. Legal norms on the organization of judiciary are one of the most important segments of constitutional matter, having in mind that for the functioning of democracy it is important to ensure complete independence of the judiciary from so-called 'political authorities' - legislative and executive. The independence of the judiciary can only be ensured by the constitution. However, the Serbian Constitution of 2006 has taken a different stand on this part of constitutional matter, giving the legislator a wide authority to regulate substantive issues relating to the judiciary (election and dismissal of judges), which largely subordinates judicial power to the legislative. First, the constitutional norms on judiciary will be analyzed in this paper. The Serbian Constitution contains five key issues related to the independence of judiciary. Further analysis will include proposed amendments to the Constitution. Ministry of Justice's Working Version of the Draft Amendments to the Constitution has not adequately solved any of five problems. Finally, useful conclusions about the position of the judiciary in the Republic of Serbia will be drawn. .

AB  - The paper analyzes Serbian system of local selfgovernment under the Constitution of 2006 and its possible improvements. There are two major aspects of reform. On the one side, there are weaknesses in internal law and practice that were detected in last three decades and six concrete proposals for their correction. On the other side, considering that Serbia negotiates on integration with the EU, some improvements of the system should be a result of that process, fully in accordance with the European standards of local self-government. Reforming the local selfgovernment in both of these directions should lead to better legal framework in the Republic of Serbia and upgrading the constitutional system.

Uticaj sistema vlasti na načelo participacije u savremenim federacijama

AB  - Jedan od najvećih izazova koji stoje pred svakim ustavotvorcem jeste odabir odgovarajućih oblika države - oblika vladavine, političkog poretka, državnog uređenja i državne vlasti. Pri tom je od izuzetne važnosti kompatibilnost koju su različiti oblici međusobno pokazali u praksi, jer od toga umnogome zavisi efikasnost konkretnog ustavnog sistema. Ovaj rad analizira odnos oblika državnog uređenja s oblicima državne vlasti, tačnije, načine na koje se složeno, federalno državno uređenje 'uklapa' s različitim sistemima vlasti - predsedničkim, skupštinskim, parlamentarnim i mešovitim (polupredsedničkim). Posebna pažnja posvećena je razmatranju odnosa sistema vlasti s načelom participacije federalnih jedinica, odnosno pitanju koliko je u kojem sistemu vlasti moguće obezbediti predstavljenost federalnih jedinica u sastavu federalnih političkih vlasti - izvršne i zakonodavne. Analizirana je i efikasnost različitih sistema vlasti, koja je neretko suprotstavljena širokoj participaciji u federaciji. Osim toga, dat je i kratak osvrt na analizu uticaja izbornih i stranačkih sistema na načelo participacije. Na kraju je učinjen pokušaj da se dâ odgovor na pitanje koji je sistem vlasti najkompatibilniji s federalnim državnim uređenjem.
AB  - One of the biggest challenges that every framer of the constitution faces with is selection of appropriate forms of state - form of rule, political system, state structure and system of government. At the same time, compatibility of these various forms shown in practice is very important, because the efficiency of the particular constitutional system largely depends on that compatibility. This paper analyzes the relationship between federal states with various systems of government, namely, the ways in which complex, federal state structure 'fits' with different systems - presidential, parliamentary, assembly and mixed. Special attention is paid to the relationship of the system of government with the principle of participation of federal units, in other words, how system of government can ensure representation of federal units within federal political authorities (legislative and executive). In this regard, paper also analysis the influence of electoral and party system to the principle of participation. In the end, there is an attempt to find the answer to the question which system of government is most compatible with the federal state.

The significance of judicial review of sub-national constitutions and laws in federal states

AB  - This article discusses various issues that emerge as a consequence of constitutional pluralism existing in federal states. Particular attention is dedicated to the relationship between constitutions of federal units and federal constitutions and laws. As a consequence of two coexisting legal systems in a federation, there are as many as six categories of general acts - a constitution, laws and bylaws of the federation, on the one hand, and constitutions, laws and bylaws of federal units, on the other. It is necessary that so many categories of legal acts are in harmony with each other, and this can be ensured only by means of judicial (constitutional) review. Two of the globally most recognized and most representative models of conformity control among different categories of legislative acts - German and American - have been presented. Particular attention is dedicated to the relationship between constitutions of federal units and federal constitutions and laws. As a consequence of two coexisting legal systems in a federation, there are as many as six categories of general acts - a constitution, laws and bylaws of the federation, on the one hand, and constitutions, laws and bylaws of federal units, on the other. AB  - Ustav Belgije iz 1831. jedan je od najstarijih važećih ustava u svetu, poznat po tome što je ostao na snazi uprkos promeni državnog uređenja. Počev od 1970, u Belgiji je sprovedeno ukupno šest državnih reformi, a ta monarhija se od centralizovane unitarne države pretvorila u decentralizovanu federaciju. Pritisci za dalju devoluciju su sve jači, a među značajnim delom pripadnika flamanske zajednice postoje jasno izražene težnje za otcepljenjem od Kraljevine Belgije i formiranjem sopstvene države. Ovaj rad u prvom delu ukratko prikazuje pet ranije sprovedenih reformi ustavnog sistema, u drugom analizira izmene koje su 2011. dogovorene političkim sporazumom (tzv. Leptirovim sporazumom), a sprovedene u šestoj državnoj reformi krajem 2013, kao i moguće epiloge državne krize, koja traje gotovo celu deceniju.
AB  - Belgian Constitution of 1831 is one of the oldest constitutions in the world which is still in force. It is well known for having remained in force despite the change of organization of state - from unitary to federal. Starting from the 1970s, six state reforms were conducted in Belgium, and the monarchy was transformed from centralized unitary state into a decentralized federation. Pressures for further devolution are getting stronger, and some of the members of the Flemish community have clearly expressed their desire for independence from the Kingdom of Belgium and the establishment of their own state. This paper in its first part analyzes five previously conducted reforms of Belgian constitutional system. The second part deals with changes agreed in so-called Butterfly agreement and implemented in sixth state reform. In the end, author is trying to anticipate possible epilogues of state crisis, which takes almost a decade.

AB  - Sledeće godine obeležiće se pet decenija otkako je u bivšoj SFR Jugoslaviji ustanovljena ustavnosudska funkcija. Kako je Ustav SFRJ od 1963. godine predvideo postojanje ustavnog sudstva i na nivou federacije i na nivou federalnih jedinica (tzv. nemački model), te godine je počeo sa radom i Ustavni sud SR Srbije, uspostavljen Ustavom SR Srbije od 1963. godine. Ustavni sud Srbije bio je predviđen i ustavima od 1974. i 1990. godine, kao i važećim Ustavom Srbije od 2006. godine, što znači da je on tokom proteklih pet decenija radio u kontinuitetu, premda su se njegova organizacija, sastav i nadležnosti menjali u nekoliko navrata. Taj organ je započeo sa radom kao ustavni sud federalne jedinice u zemlji koja je negovala socijalistički model ustavnosti, zasnovan na načelu jedinstva vlasti, dok je danas, nepunih pedeset godina nakon toga, on ustavnosudski organ jedne samostalne države, koja se vratila demokratsko-socijalnoj ustavnosti, podeli vlasti i narodnoj suverenosti.
AB  - Next year will mark five decades since the former Socialist Federal Republic of Yugoslavia had adopted a judicial review. Since the Constitution of the SFRY of 1963 established constitutional courts at the federal level as well as at the level of federal units (so-called German model), the Constitutional Court of the Republic of Serbia began its work in the same year. The Constitutional Court of Serbia continued its existence in subsequent constitutions of 1974, 1990 and 2006, which means that during the past five decades it worked continuously, although its organization, composition and competencies have changed several times. The Constitutional Court of Serbia started its work as a constitutional court of a federal unit in the federation that adopted the socialist model of constitutionality, based on the principle of the unity of powers. Today, almost fifty years later, the Constitutional Court of Serbia is the constitutional court of an independent unitary state, which has returned to the liberal- democratic model of constitutionality and the principle of separation of powers.

решења свог претходника, Устава од 1990. године. Једна од области у
које је унесено највише нових решења јесте област организације и на-
длежности Уставног суда Републике Србије. Јурисдикција Уставног суда
је значајно проширена, због чега је број његових судија повећан са девет
на 15. Повећање броја судија се, међутим, показало као недовољно да би
Уставни суд ефикасно вршио све функције које су му поверене Уставом,
због чега је законодавац крајем 2011. године посегао за новим решењем
чији је циљ повећање ефикасности рада Уставног суда. Осим посту-
пака пред Уставним судом, који су несумњиво били главна мета зако-
нодавца, изменама и допунама Закона о Уставном суду предвиђена су
нова решења и у области основних одредаба о Уставном суду, његовог
унутрашњег уређења, као и изборa, именовањa, престанка дужности и
положајa судија Уставног суда.
AB  - The Constitution of the Republic of Serbia of 2006 had largely taken the
regulations of its predecessor, the Constitution of 1990. One of areas with most
innovations is the organization and powers of the Constitutional Court. The
jurisdiction of the Constitutional Court had been significantly broadened, and,
as a consequence, number of its judges had increased from nine to 15. Increasing
number of judges, however, proved to be insufficient for the Constitutional
Court to exercise effectively all the functions assigned to it by the Constitution.
That is why the Serbian legislature in late 2011 had adopted amendments to the
Law on the Constitutional Court, designed to improve its efficiency. Procedure before the Constitutional Court undoubtedly was the main target of the new
legislation. Amendments to the Law on the Constitutional Court, however, provided
some new solutions in the fundamental provisions on the Constitutional
Court, its internal organization, as well as the selection, appointment and termination
of office of its judges, and position of the Constitutional Court in the
constitutional system in general.

AB  - Ustavni sud Španije je, nakon četvorogodišnjeg postupka, 28. juna 2010. godine konačno doneo odluku o ustavnosti Statuta Katalonije od 2006. godine. Ta španska autonomna zajednica je u Statutu, prema mišljenju španskog Ustavnog suda, prekoračila granice svog autonomnog delokruga. Katalonija je, nakon odluke Ustavnog suda Španije o ustavnosti njenog Statuta o autonomiji, ispoljila nameru da istupi iz sastava Španije. Odluka Ustavnog suda o neustavnosti nekolicine odredaba Statuta izazvala je, razumljivo, oprečne reakcije kako u javnosti, tako i među ustavnopravnim stručnjacima i dovela do ustavne i političke krize u Španiji. Ovaj rad je posvećen ustavnopravnoj analizi odluke Ustavnog suda Španije o ustavnosti Statuta Katalonije, analizi pravnih i političkih posledica koje je takva odluka proizvela, kao i razmatranju mogućnosti za eventualno sprečavanje jednostrane secesije te autonomne zajednice.
AB  - After the Spanish Constitutional Court decision on the constitutionality of the Statute of Autonomy of Catalonia, the officials of this autonomous community have expressed intention to organize a referendum with regards to its independence. According to the ruling of the Spanish Constitutional Court, Catalonia had overstepped the limits of its autonomous jurisdiction in the new Statute. The decision of the Constitutional Court on the constitutionality of several provisions of the Statute have provoked negative reactions of both the general public and the constitutional experts of Catalonia, and resulted in constitutional and political crisis in Spain. This paper is devoted to the analysis of the aforesaid decision of the Constitutional Court of Spain, examination of its legal and political consequences, and assessment of the likelihood of preventing the scenario of unilateral secession.

сланик слободан да, под условима одређеним законом, неопозиво стави
мандат на располагање политичкој странци на чији је предлог изабран
за народног посланика. Тиме је на неуобичајен, „заобилазан“ начин про-
мењена природа посланичког мандата, јер је он, иако правно слободан,
учињен политички императивним. Овакво уставно решење је од почет-
ка жестоко критиковано, како од стручне јавности, тако и од респек-
табилних међународних организација, што законодавца није спречило
дa покуша да даље разради спорну уставну норму. Ништа мење крити-
ке није трпео ни тзв. систем невезаних изборних листа, установљен
Законом о избору народних посланика. Но, недавно су, услед великих при-
тисака представника међународне заједнице, ипак предложене измене
и допуне спорних законских одредаба које регулишу изборну материју.
Своје мишљење о нормативном квалитету предложених решења изнела
је и Венецијанска комисија, у сарадњи са Канцеларијом за демократске
институције и људска права ОЕБС-а. Штавише, тај документ је довео
до тога да измене и допуне Закона о избору народних посланика добију
друкчији облик од оног који је првобитно предложен.
AB  - The Constitution of the Republic of Serbia of 2006 states that an MP is
free to put his/her irrevocable mandate at the disposal of the political party,
upon which proposal he or her was elected a deputy, under conditions specified
by law. This is unusual, „roundabout“ way to change the legal nature of parliamentary
mandate. Parlamentary mandate, though legally free, was made a
politicaly imperative by this constitutional norm. Such a constitutional solution
has been heavily criticized from the beginning, both by legal experts and by the
respective international organizations, which did not prevent Serbian legislature
to try to further develop the controversial constitutional norm. But recently,
due to a lot of pressure from the representatives of the international community,
however, amendments to the disputed legal provisions regulating this matter
were proposed. The Venice Commission, in cooperation with the Office for
Democratic Institutions and Human Rights of the OSCE, gave their vision of
the normative quality of the proposed solutions. Moreover, this document has
resulted in amendments to the Law on Election of Members of Parliament receive
a different form than that originally proposed.

AB  - Federalno državno uređenje predstavlja najrasprostranjeniji oblik tzv. vertikalne podele vlasti u svetu, ali i efikasan instrument za rešavanje problema multikulturalnosti društva. Od nešto više od dvadeset federacija koliko ih danas ima na planeti, svega se četiri nalaze na afričkom kontinentu - Južnoafrička Republika, Nigerija, Komorska Ostrva i Etiopija. Iako je nakon Drugog svetskog rata izgledalo da će broj saveznih država u Africi biti mnogo veći, ovaj oblik državnog uređenja nije uspeo da ' pusti korene ' na njenom području, pa se veliki broj federalnih eksperimenata završio lošim rezultatom. Dobar primer neuspele federacije predstavlja neobična unija Etiopije i Eritreje, koja se održala svega deset godina (1952-1962). Etiopija se, međutim, tri decenije nakon toga definitivno federalizovala, promenivši unutrašnju strukturu iz jednostavne u složenu. Ovaj 'drugi pokušaj' uvođenja federalizma u Etiopiji bio je uzrokovan pre svega višenacionalnošću i višejezičnošću populacije, što je često zahtevalo i specifična institucionalna rešenja.
AB  - Federal government is the most prevalent pattern of the vertical distribution of powers in the world. It may also serve as an efficient instrument for settling down the problems of multicultural societies. 'The second attempt' of the federalization of Ethiopia was provoked mainly by the multiethnicity and multilinguality of the population, which usually calls for specific institutional solutions. From the normative stance, the Ethiopian state is an uncommon federation. It combines some of the unitary, federal and confederal legal institutions. On one side, the inadequate application of the participation principle, and the absence of judicial review depict Ethiopia as a decentralized unitary state. On the other hand, the constitutionalization of secession, and the unusually rigid procedure for constitutional change come out as the pure confederal elements in the Ethiopian constitutional mechanism. It is difficult, therefore, to classify Ethiopian institutional arrange­ment as completely federal in its structure and distribution of powers; and even the Ethiopian authors disapprove of it. The experience will show if such an odd form of federal government was proper frame for the democratization of the Ethiopian society and for the establishment of the rule of law. However, there is no doubt that the young African federation will face many 'constitutional storms' in the future.

AB  - Od skoro dve stotine država koje su danas članice OUN, svega desetak procenata čine federacije. Iako njihov broj nije veliki, teritorijalna prostranstva koja federacije zauzimaju, brojnost stanovništva koje ih naseljava i ekonomska snaga kojom raspolažu, vrlo su respektabilni, pa se slobodno može reći da je većina najmoćnijih država sveta danas federalno ustrojena. Stoga federalizam, kao najrasprostranjeniji oblik vertikalne podele vlasti u svetu, zaslužuje počasno mesto među danas poznatim modelima teritorijalne decentralizacije, a upravo Australija pruža jedan od najsvetlijih uporednopravnih primera uspešne primene tog oblika državnog uređenja. Ipak, i ova država-kontinent je, nakon više od stoleća života pod federalnim ustavom, u ovom momentu suočena sa izvesnim problemima i dilemama koji su neminovno proizašli iz promena društvenih prilika i uloge države tokom jednog veka. Osnovni problemi s kojima se australijska federacija trenutno susreće su pitanja promene oblika vladavine, povećanja broja federalnih jedinica i preraspodele nadležnosti između savezne vlasti i država - članica.
AB  - The federal system combined with parliamentary regime, predominantly inspired by the constitutional arrangements of the Great Britain and the USA, turned out to be the optimal solution for constitutionalization of the Australian political community. One century after promulgation of its federal constitution, Australia has built the stable and democratic political institutions, which correspond to the federal principles defined in its constitutional doctrine (the principles of supremacy, autonomy and participation). The greatest anomaly of the Australian federal arrangement is in its specific technique of de facto constitutional changes. These changes occur by means of adopting the laws which are opposing to the constitution and their confirmation by the Supreme Court through the exercise of power of judicial review. Australia has faced some new challenges at the end of the 20th century, and amongst those challenges one should stress out the transfer from monarchy to the republic and the creation of the new federal entity (Northern Territory). The Australians voted against these two changes, but the way those issues were resolved shows that any similar questions in the future should not disturb the coherence of the Australian constitutional system.
