Who works more, and who works smarter? Comparing judicial performance in Europe

AB  - This paper (1) analyzes the existing theoretical framework for under standing the relationship between the judicial performance and judicial efficiency,
(2) compares the judicial performances in Serbia, Croatia, Slovenia, France, Austria, 
and Norway for the year 2020, (3) compares the judicial performances in different 
instances in Serbia for the same year, and (4) examines the performance standards 
that are set by law for Serbian judges. The authors conclude that in 2020 Serbian 
judges resolved more cases in all instances (there is a higher number of resolved cas es per judge only in Austria, in first instance), while at the same time falling short of 
the caseload standards set in Serbian law. Also, the study found excessive difference 
in the performance of Serbian courts, but that does not affect the evaluation of judges, since 485 evaluated judges out of 505 got the rating “exceptionally successfully 
performs the function of judge” for the year 2020.
AB  - U ovom radu (1) analiziramo postojeć i teorijski okvir za razumeva nje relacije između sudijske produktivnosti i sudske efikasnosti, (2) upo ređujemo sudijsku produktivnost u različitim instancama u Srbiji tokom 
2020. godine, (3) upoređujemo sudijsku produktivnost u Srbiji sa produk tivnošću sudija u Hrvatskoj, Sloveniji, Francuskoj, Austriji i Norveškoj za 
istu godinu, (4) ispitujemo sudijsku normu koja je predviđena zakonom 
za srpske sudije. Autori zaključuju da su srpske sudije rešile više pred meta u svim instancama u 2020. godini (samo Austrija u prvom stepenu 
ima već i broj rešenih predmeta po sudiji), dok istovremeno ne ispunjavaju 
sudijsku normu koja je postavljena zakonom. Takođe, autori konstatuju 
veliku razliku u broju rešenih predmeta po sudiji u sudovima u Srbiji, ali 
se to ne odražava na ocenjivanje sudija u Srbiji, jer je 485 ocenjenih sudija 
od ukupno 505 sudija dobilo ocenu „izuzetno uspešno obavljaju funkciju 
sudije” za 2020. godinu.

AB  - U ovom radu bavimo se odnosom između relativnog broja sudija u okviru jedne jurisdikcije i efikasnosti pravosuđa. Da bismo utvrdili kako broj sudija utiče na efikasnost, upoređujemo podatke o pravosuđu iz šest zemalja: Srbije, Hrvatske, Slovenije, Francuske, Austrije i Norveške. Analiza je zasnovana na podacima prikupljenim u 2018. godini od strane CEPEJ-a i Indeksa vladavine prava World Justice Report-a za 2018. godinu. Zaključujemo da se efikasnost pravosuđa ne poveć ava sa poveć anjem broja sudija u jednoj jurisdikciji.
AB  - In this paper, we deal with the relationship between the relative number of judges within a jurisdiction and the efficiency of the judiciary. To determine how the number of judges influences efficiency, we compare data on the judiciary from six countries: Serbia, Croatia, Slovenia, France, Austria and Norway. The analysis is based on data collected within the 2020 Evaluation cycle (2018 data) of CEPEJ and World Justice Report Rule of Law Index for 2018. We conclude that judicial efficiency does not increase with an increase in the number of judges in a jurisdiction.

Paralelna normativna realnost: neformalni poredak korupcije i klijentelizma u Srbiji

AB  - In contemporary Serbia, political and economic elite members systematically break the law with impunity. The paper explains this phenomenon by relying on theory and data from legal theory, sociology, and political science. The behaviour of officials in contemporary Serbia can be explained by analysing complex interactions between state law and informal norms that arise from informal institutions of clientelism and corruption. These norms form a parallel normative order (1) composed of mutual expectations regarding the behaviour of others and consequences for not complying with these expectations. (2) It is based on social and political powers that strengthen informal institutions and the normative order. (3) Norms of this order regulate the behaviour of actors, and (4) they are mutually harmonised, with the norm of loyalty central to the normative order. (5) The parallel normative system suspends state law for political and economic actors who respect informal rules while using mechanisms, rules, and resources of state law to sanction violations of informal norms that are considered crucial for maintaining the informal order. The relation between formal state law and the informal normative order is one of conflict, competition, and parasitisation. To elaborate on these findings, we explain the concepts of informal rules, institutions, and orders, along with an exposition and analysis of typologies of their relations. We then present and analyse empirical research data about corruption and clientelism in Serbia. Finally, based on the theoretical framework and the available data, we conclude that there is ample evidence that a parallel normative order is established and sustained in Serbia.

Interpretacija i konstrukcija - prilog razmatranju razlike između primjene prava i stvaranja prava

AB  - U okviru svojih redovnih aktivnosti sudovi pripisuju značenja pravnim tekstovima da bi utvrdili normativnu situaciju stranaka u sporu. Aktivnost pripisivanja značenja pravnim tekstovima od strane sudova uobičajeno nazivamo autoritativnim tumačenjem prava. U velikom broju slučajeva, značenje koje tekstu pripisuje sud na različite načine odstupa od onoga što bi laici, pa čak i pravnici očekivali, a sama odstupanja se u pravnoj teoriji objašnjavaju na različite načine. U svrhu objašnjenja koriste se pojmovi stvaranja i primjene prava, ekstenzivnog i restriktivnog tumačenja, secundum, praeter i contra legem presuđivanja. U ovom radu se pak razmatraju shvatanja interpretacije, konstrukcije i njihovog odnosa, kao moguća objašnjenja situacija u kojima autoritativno tumačenje odstupa od očekivanja stručne i laičke javnosti. U tu svrhu, izlažu se savremena tekstualistička i intencionalistička (kognitivistička) shvatanja interpretacije i konstrukcije i upoređuju se sa savremenim skeptičkim shvatanjima. Uprkos jednostavnosti i intuitivnoj prihvatljivosti nekih kognitivističkih stanovišta, pokazuje se da skeptička shvatanja daju bolju teorijsku osnovu za razmatranje primjene i stvaranja prava od strane sudova. Samo razlikovanje između interpretacije i konstrukcije pokazuje se kao korisno teorijsko oruđe za objašnjenje postupanja sudova, kao i za preciziranje postojećih teorijskih razlikovanja.
AB  - As part of their regular activities, courts attach meaning to legal texts to determine the normative situation of the parties to the dispute. The activity of attributing meaning to legal texts by the courts is commonly called authoritative interpretation of law. In many cases, the meaning attributed to the text by the court deviates significantly from what laymen and even lawyers would expect, and the deviations themselves are explained in different ways in legal theory. In the purpose of explanation, the terms creation and application of law, extensive and restrictive interpretation, secundum, praeter and contra legem adjudication are used. This paper introduces and explains the concepts of interpretation, construction and their relationship, as possible explanations of situations in which authoritative judicial interpretations deviate from the expectations of the professional and lay public. For this purpose, contemporary textualist and intentionalist (cognitivist) conceptions of interpretation and construction are presented and compared with contemporary skeptical (realist, antiformalist) conceptions. Despite the simplicity and intuitive acceptability of some cognitivist views, skepticism is shown to provide a better theoretical basis for considering the application and creation of rights by courts. The very distinction between interpretation and construction proves to be a useful theoretical tool for explaining the actions of courts, as well as for specifying existing theoretical distinctions.

Epistemic Authority and Legal Interpretation

AB  - The relations between epistemic authority and legal interpretation have been widely neglected in contemporary legal theory. In this paper I’ll lay out the grounds for the discussion about the sociological and philosophical conceptions of power and authority in order to access their relevance for the theory of legal interpretation. The main hypothesis is that the problems of the practice of legal interpretations in contemporary legal systems are by and large solved not by resorting to philosophies of language nor by doctrines of legal interpretation, but by relying on various kinds of authorities. The paper will present (1) an analysis of authority that will lead to the kinds of authority that are relevant for legal interpretation and argue that (2) the proper way to understand these authorities is by employing the concept of institutional control of legal interpretation. The analysis substantiates the conclusion that authority is a key component of understanding judicial interpretation as a volitive or stipulative enterprise, without implications of arbitrariness.

AB  - Pravo na obrazloženu presudu koje je Evropski sud za ljudska prava stvorio u sopstvenoj praksi, zasnivajući ga na pravu na pravično suđenje, u nekim slučajevima služi strazburškom Sudu da se upusti u instanciono odlučivanje povodom predstavki u vezi s članom 6 Konvencije. To pitanje je i praktično i teorijski relevantno jer taj Sud, u skladu s doktrinom "četvrte instance" po pravilu ne postupa kao instancioni sud. U analizi nekoliko temeljnih slučajeva, autori u članku pokazuju pod kojim uslovima i na koji način se Sud u Strazburu upušta u meritorno rešavanje sporova između građana i država članica. Zaključak je da nije reč o tome da ESLJP, kada utvrđuje da li je došlo do povrede prava na obrazloženu presudu, slučajno ili nesmotreno odstupi od doktrine "četvrte instance" već o tome da je u nizu presuda ESLJP sâmo pravo na obrazloženu presudu formulisao tako da ono po sebi odstupa od te doktrine.
AB  - Right to a reasoned judgement, created by the European Court of Human Rights is used in some cases by the Court in Strasbourg to justify acting as a court of higher instance in relation to national courts regarding the article 6 of the Convention. This issue is relevant both for legal theory and legal practice, because the Court, according to the fourth instance doctrine, does not act as an instance court. By analyzing key cases, the authors show under which conditions and in what way the Strasbourg Court rules on the substance of cases. It is concluded that ECHR, in the case of the right to a reasoned judgement, does not stray from the fourth instance doctrine occasionally or by chance. A series of decisions show that the ECHR formulated the right to a reasoned judgement in such a way that the right itself deviates from the fourth instance doctrine.

AB  - The paper gives an overview of recent doctrines of legal interpretation that can be subsumed under the common name “institutional turn” in theories of legal interpretation. Among the reviewed theoretical positions are the ones from Jeremy Wаldron, Victoria Nourse, Cass Sunstein, Adrian Vermeule, Scott Shapiro. It is concluded that the institutional turn in legal interpretation offers some significant insights into legal interpretation and interesting perspectives on the appropriate interpretative methodologies. The turn, however, does this by eschewing parts of traditional accounts of legal interpretation that are arguably worth preserving in any theory of legal interpretation.

AB  - The paper analyzes one of the main influences on the results of legal interpretation - epistemic authority. An account of authority is given along with a distinction between two basic types of authority, followed by a brief explanation of practical authority. Epistemic authority and derivative epistemic authority in particular are explained, in order to propose the conditions under which the influence of epistemic authority on judicial interpretation is justified. Dva poimanja pravnih principa

AB  - Klasično shvatanje pravnih principa kao najopštijih normi pravnog poretka razmatra se u ovom radu kritički, iz perspektive Dvorkinovog i Aleksijevog shvatanja pravnih principa kao prima facie naloga za djelovanje. Za razliku od uvreženog stanovišta u teoriji prava na ovim prostorima, koje u krajnjoj liniji dovodi u pitanje pravne principe kao naloge za djelovanje, pokazuje se da je drugačije shvatanje pravnih principa značajno za pravnu praksu te sljedstveno i za pravnu dogmatiku. Heuristička plodnost razumijevanja principa kao optimizacionih komandi jasno se sagledava kada se oni povežu s analizom proporcionalnosti kao osnovnim načinom primjene pravnih principa. Taj se način razlikuje od supsumptivnog načina primjene pravnih pravila. Teorija principa koju izlažu Dvorkin i Aleksi pokazuje se u tom smislu kao normativno i deskriptivno bolja od drugačijih shvatanja, ali ima i manjkavosti, koje se, prije svega, ogledaju u tome što ne sadrži precizne upute za ex ante razlikovanje i klasifikaciju pravnih normi na pravila i principe.
AB  - The paper discusses the classical understanding of legal principles as the most general norms of a legal order, confronting it with Dworkin's and Alexy's understanding of legal principles as prima facie, unconditional commands. The analysis shows that the common, classical conception brings into question the status of legal principles as norms, by disreguarding their usefulness in judicial reasoning, while, conversely, the latterhas significant import forlegal practice and consequently for legal dogmatics. It is argued that the heuristic fruitfulness of understanding principles as optimization commands thusbecomesapparent. When we understand the relation of priciples to the idea of proportionality, as thespecific mode of their application, which is different from the supsumtive mode of applying rules, the theory of legal principles advanced by Dworkin and Alexy appears therefore to be descriptively better than others, but not without its flaws.

AB  - Poslednje decenije XX veka su i u okviru filozofije, čiji je osnovni problem jezik, dovele do preokreta koji se naziva interpretativnim okretom. U mnoštvu uticaja koje je filozofija prava pretrpjela od analitičke i kontinentalne tradicije u filozofiji jednim su dijelom ostali zanemareni oni uticaji koji potiču od same teorijske jurisprudencije, ona pravila koja proizilaze od same praktičke jurisprudencije, te se u neku ruku i izgubila samosvojnost koju je Kelsen, izgrađujući čistu teoriju prava, želio da podari pravnoj nauci. Centralna tema najvećeg dijela doktorske disertacije jeste upravo hermenautika uopšte i hermenautika jednog italijanskog pravnika posebno.
AB  - The so-called interpretative turn has been a major development in the last two decades in philosophy. Among the variety of influences that the philosophy of law has experienced from analytical and phenomenological tradition, the influences derived from theoretical jurisprudence have remained neglected resulting in the dissolving of the self-contained character of legal science that Kelsen established by building his a pure theory of law. The core topic of this doctoral thesis is hermeneutics in general, with an emphasis on hermeneutics and legal hermeneutics developed by an Italian jurist and philosopher of law - Emilio Betti.

AB  - U radu se izlažu osnovni pravci razvoja u filozofiji prava u prethodnih nekoliko decenija sa stanovišta metateorijskog razlikovanja između analitičke i hermeneutičke perspektive u proučavanju prava. Autor tvrdi da se skorije filozofije prava mahom ne pozicioniraju u okvirima tradicionalne dihotomije jusnaturalizam - pravni pozitivizam, te da ta dihotomija sve manje uspjeva da objasni razlike između savremenih poimanja prava. Kao alternativa se izlaže razlika između analitičke filozofske tradicije i hermeneutičke filozofske tradicije koje se presudno uticale na oblikovanje posthartovskih strujanja u anglosaksonskoj filozofiji prava i postkelzenovskih strujanja u kontinentalnoj filozofiji prava. Konačno, ispituje se uticaj hermeneutičke filozofije i pravne teorije kod nas kako u pogledu izgradnje hermeneutičke teorije prava tako i u pogledu izgradnje teorije pravne hermeneutike.
AB  - The article examines the main strands of development in jurisprudence in the last few decades from the standpoint of the metatheoretical differentiation between analytical and hermeneutical perspective in the study of law. The author claims that recent jurisprudent accounts can rarely be positioned within the traditional dichotomy natural law theories - legal positivism, and that this dichotomy is not able to account for the differences between contemporary conceptions of law. As an alternative the difference between the analytical and hermeneutical traditions in philosophy are explained, as they have crucially influenced posthartian strands in Anglo-American philosophy and postkelsenian strands in continental philosophy of law. Finally, the influence of hermeneutical philosophy and legal theory is examined in regards of the development of a hermeneutical theory of law and the development of legal hermeneutics.

Autor tvrdi da se skorije filozofije prava mahom ne pozicioniraju u okvirima tradicionalne dihotomije jusnaturalizam - pravni pozitivizam, te da ta dihotomija sve manje uspjeva da objasni razlike između savremenih poimanja prava. Kao alternativa se izlaže razlika između analitičke filozofske tradicije i hermeneutičke filozofske tradicije koje se presudno uticale na oblikovanje posthartovskih strujanja u anglosaksonskoj filozofiji prava i postkelzenovskih strujanja u kontinentalnoj filozofiji prava. On the Essential Contestedness of the Concept of Law Gallie's Framework for Essentially Contested Concepts Applied to the Law

AB  - The article examines the inadequacies of different approaches in defining the concept of law in legal theory and suggests that by categorizing the concept of law as essentially contested we can account for permanent conceptual disputes in legal theory. The author argues that the concept of law fits five descriptive criteria for essential contestedness suggested by Walter Bryce Gallie. It is further suggested that by taking this point of view makes us deflate the value of definitions understood in terms of necessary and universally valid explanations of a concept, and emphasize the importance of different conceptions of key concepts in legal theory.

AB  - U članku se ispituju manjkavosti različitih pravnoteorijskih pristupa u definisanju pojma prava, kako bi se otvorio prostor za razumjevanje tog pojma kao suštinski spornog na osnovu kriterijuma koje je predložio britanski politički i društveni teoretičar Brus Volter Gali. Po stanovištu koje autor zauzima, ovakva kategorizacija pojma prava objašnjava (iz konceptualno-analitičke perspektive) istrajnost pojmovnih debata u pravnoj teoriji i filozofiji prava. Ova se osnovna postavka dalje razvija u pravcu devalvacije značaja definicija, shvaćenih kao nužno i opštevažeće određenje ključnih pojmova u društvenoj i pravnoj teoriji, u korist naglašavanja značaja različitih poimanja prava i poimanja pojma prava.
